Section 131 BNS 2023: Punishment for Assault or Criminal Force Otherwise Than on Grave and Sudden Provocation

Section 131 of the Bharatiya Nyaya Sanhita, 2023 (BNS) assault या criminal force के सामान्य form के लिए punishment निर्धारित करता है, जब act grave and sudden provocation के कारण नहीं किया गया हो। यह Section 130 में defined assault और Section 129 में defined criminal force का principal general punishment provision है।

Section 131 BNS

Statutory Provision

Section 131 BNS के अनुसार, जो व्यक्ति किसी व्यक्ति पर assault या criminal force करता है, और यह act उस व्यक्ति द्वारा दी गई grave and sudden provocation के कारण नहीं किया गया है, उसे:

  • Imprisonment of either description — अधिकतम 3 महीने, या

  • Fine — अधिकतम ₹1,000, या

  • दोनों

से punish किया जा सकता है।

यह provision पुराने Section 352 IPC का corresponding provision है और दोनों में मूल statutory language लगभग समान है। (IndiaCode by eCourtsIndia)

इसलिए Section 131 सामान्यतः non-cognizable और bailable offence है।

Essential Ingredients

Section 131 में conviction के लिए मुख्यतः निम्न ingredients महत्वपूर्ण हैं।

Assault or Criminal Force

सबसे पहले accused द्वारा assault या criminal force किया जाना चाहिए।

“Criminal force” की definition Section 129 BNS में और “assault” की definition Section 130 BNS में दी गई है।

इसलिए Section 131 को Sections 129 और 130 के साथ पढ़ना आवश्यक है।

Absence of Grave and Sudden Provocation

Section 131 का दूसरा महत्वपूर्ण element है कि assault या criminal force grave and sudden provocation given by that person के कारण नहीं होना चाहिए।

यदि accused यह establish करता है कि उसे victim की ओर से grave and sudden provocation मिली थी, तो Section 131 की punishment का question Section 136 जैसे specific provision के संदर्भ में examine किया जा सकता है। Section 136 ऐसे assault/criminal force के लिए अलग punishment देता है जो grave and sudden provocation पर किया गया हो।

Meaning of Grave and Sudden Provocation

BNS Section 131 में “grave and sudden provocation” की कोई exhaustive definition नहीं दी गई है। इसलिए इसका determination facts and circumstances के आधार पर किया जाता है।

Section 131 का Explanation 2 expressly कहता है कि क्या provocation इतनी grave और sudden थी कि offence को mitigate किया जाए, यह question of fact है।

इसका अर्थ है कि Court को प्रत्येक case के circumstances, conduct of parties, timing, surrounding events और accused की स्थिति को देखना होगा।

When Provocation Will Not Mitigate Punishment

Section 131 का Explanation 1 तीन महत्वपूर्ण situations बताता है जिनमें grave and sudden provocation punishment को mitigate नहीं करेगी।

Provocation Was Sought or Voluntarily Provoked

यदि accused ने स्वयं provocation को seek या voluntarily provoke किया था ताकि बाद में उसे offence के लिए excuse बनाया जा सके, तो वह provocation Section 131 के तहत mitigation का आधार नहीं बनेगी।

Act Done in Obedience to Law

यदि alleged provocation किसी ऐसे act से उत्पन्न हुई जो obedience to law में किया गया था, तो वह Section 131 के लिए mitigating grave and sudden provocation नहीं मानी जाएगी।

Lawful Exercise by Public Servant

यदि provocation किसी public servant द्वारा उसकी lawful powers के exercise में किए गए act से उत्पन्न हुई, तो Section 131 का mitigation उपलब्ध नहीं होगा।

Lawful Private Defence

यदि alleged provocation किसी व्यक्ति द्वारा lawful exercise of right of private defence में किए गए act से उत्पन्न हुई है, तो वह Section 131 के तहत mitigating provocation नहीं होगी।

Difference Between Section 131 and Section 136

यह distinction अत्यंत महत्वपूर्ण है।

Section 131 BNS तब लागू होता है जब assault/criminal force grave and sudden provocation के बिना किया गया हो।

Section 136 BNS तब लागू होता है जब assault/criminal force grave and sudden provocation given by that person पर किया गया हो।

Section 136 की punishment केवल simple imprisonment up to one month, fine up to ₹1,000, or both है।

BNSS First Schedule Section 131 और 136 दोनों को non-cognizable और bailable classify करता है।

Difference Between Section 131 and Section 132

Section 131 general assault/criminal force से संबंधित है।

Section 132 तब लागू होता है जब assault या criminal force किसी public servant पर उसके duty के execution में, उसे duty करने से prevent/deter करने के intent से, या उसके lawful discharge of duty के कारण किया जाता है। Section 132 में punishment up to 2 years imprisonment, fine, or both है और BNSS First Schedule इसे cognizable तथा non-bailable offence classify करता है।

इसलिए public servant के official duty से जुड़ा assault केवल Section 131 के तहत नहीं बल्कि facts के अनुसार Section 132 के तहत भी specifically examine किया जाना चाहिए।

Difference Between Section 131 and Section 133

Section 133 तब लागू होता है जब assault या criminal force का specific intention to dishonour हो और act grave and sudden provocation के कारण न किया गया हो।

Section 133 में punishment up to 2 years imprisonment, fine, or both है।

इसलिए Section 133 में intention to dishonour additional ingredient है, जबकि Section 131 general provision है।

Difference Between Section 131 and Section 134

Section 134 तब लागू होता है जब assault/criminal force किसी व्यक्ति द्वारा पहनी या carry की जा रही property की theft करने के attempt में किया जाता है।

इस offence में maximum punishment 2 years imprisonment, fine, or both है।

यदि assault/criminal force का purpose theft attempt है, तो specific Section 134 facts के अनुसार relevant होगा।

Leading Supreme Court Judgment on Grave and Sudden Provocation

K.M. Nanavati v. State of Maharashtra

AIR 1962 SC 605; 1962 Supp (1) SCR 567

K.M. Nanavati v. State of Maharashtra grave and sudden provocation के Indian criminal law jurisprudence की leading Supreme Court authority है।

Supreme Court ने कहा कि “grave and sudden provocation” के लिए कोई abstract universal standard निर्धारित नहीं किया जा सकता। Court को circumstances के context में यह देखना होता है कि accused की स्थिति में उसी social background का reasonable person इतना provoked होता कि वह self-control temporarily खो देता। (Casemine)

Court ने यह भी emphasise किया कि provocation और resulting act के बीच temporal proximity महत्वपूर्ण है। यदि passion cool हो चुका है और accused को premeditation तथा calculation का पर्याप्त opportunity मिल चुका है, तो subsequent act को grave and sudden provocation के प्रभाव में किया गया act मानना कठिन होगा। (Casemine)

यह principle Section 131 के Explanation 2 के application में अत्यंत relevant है, क्योंकि BNS भी expressly कहता है कि provocation grave and sudden थी या नहीं, यह question of fact है।

2022 INSC 79; Supreme Court of India

Supreme Court ने K.M. Nanavati के principles को reaffirm करते हुए कहा कि grave and sudden provocation के लिए reasonable man का test apply किया जाना चाहिए, न कि unusually excitable या pugnacious व्यक्ति का।

Court ने यह भी emphasise किया कि यह examine करना आवश्यक है कि accused को self-control वापस पाने और passion cool होने के लिए sufficient time मिला था या नहीं। (Indian Kanoon)

यह principle Section 131 के Explanation 2 के context में विशेष रूप से महत्वपूर्ण है।

(2012) 13 SCC 663

Supreme Court ने grave and sudden provocation के doctrine को apply करते हुए कहा कि Court को reasonable prudence के दृष्टिकोण से यह examine करना चाहिए कि circumstances ऐसी थीं या नहीं जिनमें व्यक्ति temporarily self-control खो सकता था।

Court ने यह भी recognise किया कि provocation किसी single act तक सीमित होना आवश्यक नहीं; previous acts का background भी relevant हो सकता है, provided the final act/word/gesture produces the requisite sudden provocation and the reaction remains connected with that loss of self-control. (Science API)

Evidence and Burden of Proof

Grave and sudden provocation का benefit claim करने पर Bharatiya Sakshya Adhiniyam, 2023 का Section 108 महत्वपूर्ण है।

Section 108 के अनुसार, जब accused किसी General Exception या special exception/proviso की circumstances का benefit claim करता है, तो उन circumstances के existence को establish करने का burden accused पर होता है और Court ऐसी circumstances की absence presume करती है, जब तक contrary prove न हो।

इसलिए Section 131 के context में यदि accused grave and sudden provocation का benefit claim करता है, तो Section 108 BSA के burden-of-proof principle को ध्यान में रखना आवश्यक है।

Compounding of Section 131

BNSS Section 359 की table में “Assault or use of criminal force” under Sections 131, 133 and 136 को compoundable offences में शामिल किया गया है।

इसे person assaulted or to whom criminal force is used compound कर सकता है, subject to BNSS Section 359 की statutory requirements।

अर्थात Section 131 offence के मामले में parties के बीच settlement/compounding का statutory mechanism उपलब्ध है।

Practical Examples

Example of Section 131

A और B के बीच कोई grave and sudden provocation नहीं हुई। A जानबूझकर B को थप्पड़ मार देता है।

यदि facts से assault/criminal force establish होता है और कोई more specific provision applicable नहीं है, तो Section 131 के ingredients consider किए जा सकते हैं।

Example Where Section 136 May Apply

B अचानक A को ऐसी grave and sudden provocation देता है जिससे A तत्काल self-control खोकर B पर assault करता है।

यदि Court evidence के आधार पर provocation को वास्तव में grave and sudden मानती है, तो facts Section 136 के तहत examine किए जा सकते हैं।

Example Where Provocation Will Not Help

यदि A पहले जानबूझकर B को provoke करता है और फिर B की प्रतिक्रिया को excuse बनाकर B पर assault करता है, तो Section 131 Explanation 1(a) के कारण A grave and sudden provocation का mitigation claim नहीं कर सकता।

Section 131 and Mens Rea

Section 131 का application Sections 129 और 130 के underlying concepts से जुड़ा है।

यदि conduct criminal force है, तो Section 129 के ingredients—जैसे intentional use of force without consent और prescribed intention/knowledge—देखे जाएंगे।

यदि conduct assault है, तो Section 130 के अनुसार gesture/preparation और apprehension of imminent criminal force का question आएगा।

इसलिए केवल physical contact या quarrel का होना Section 131 की liability को automatically establish नहीं करता। Prosecution को applicable substantive ingredients establish करने होंगे।

Section 131 BNS को तीन स्तरों पर समझना चाहिए:

First: Section 129 — criminal force की definition।

Second: Section 130 — assault की definition।

Third: Section 131 — जब assault/criminal force grave and sudden provocation के कारण नहीं हुआ हो, तब general punishment।

यदि grave and sudden provocation legally established है, तो facts के अनुसार Section 136 लागू हो सकता है। यदि public servant, dishonour, theft या wrongful confinement जैसे specific circumstances मौजूद हैं, तो Sections 132–135 के specific provisions भी relevant हो सकते हैं।
