Section 130 BNS 2023: Assault – Definition, Ingredients, Examples and Supreme Court Judgments

Section 130 of the Bharatiya Nyaya Sanhita, 2023 (BNS) “assault” की statutory definition देता है। इसमें actual physical force का इस्तेमाल होना आवश्यक नहीं है; यदि कोई व्यक्ति ऐसा gesture या preparation करता है जिससे सामने मौजूद व्यक्ति को यह apprehension हो कि उस पर criminal force का तत्काल प्रयोग होने वाला है, तो Section 130 के अंतर्गत assault हो सकता है।

यह provision पुराने Section 351 IPC के corresponding concept को आगे बढ़ाता है। BNS में Section 130 definition provision है, जबकि सामान्य assault की punishment Section 131 BNS में दी गई है। (India Code)

Statutory Provision

Section 130 BNS के अनुसार, जो व्यक्ति कोई gesture या preparation इस intention से या इस knowledge के साथ करता है कि उसके द्वारा किया गया gesture या preparation किसी person present को यह apprehend करने के लिए cause करेगा कि वह उस व्यक्ति पर criminal force use करने वाला है, वह assault करता है।

Section का Explanation यह स्पष्ट करता है कि mere words alone do not amount to assault। लेकिन words, यदि किसी gesture या preparation को ऐसा meaning देते हैं जिससे statutory apprehension पैदा होती है, तो वे gesture या preparation को assault बना सकते हैं।

Meaning of Assault

Section 130 में assault का focus actual injury या actual physical force पर नहीं बल्कि apprehension of imminent criminal force पर है।

इसका अर्थ है कि आरोपी ने अभी victim को मारा नहीं है, फिर भी उसका conduct ऐसा हो सकता है जिससे victim को reasonably apprehend हो कि आरोपी अभी उस पर criminal force इस्तेमाल करने वाला है।

इसलिए assault एक ऐसा offence है जिसमें threatening conduct embodied in a gesture or preparation महत्वपूर्ण है।

Essential Ingredients

Gesture or Preparation

Accused द्वारा कोई gesture या preparation किया जाना चाहिए।

Gesture का अर्थ केवल hand gesture तक सीमित नहीं है। Conduct का overall nature देखा जाएगा कि क्या उससे victim को criminal force के imminent use की apprehension हो सकती थी।

Preparation भी ऐसी होनी चाहिए जो statutory apprehension पैदा करने के लिए पर्याप्त हो।

Intention or Knowledge

Accused का intention या knowledge होना चाहिए कि उसके gesture या preparation से सामने मौजूद व्यक्ति को यह apprehension हो सकती है कि criminal force use होने वाला है।

इसलिए केवल कोई harmless gesture या accidental movement Section 130 के लिए पर्याप्त नहीं है।

Person Must Be Present

Section 130 में “any person present” शब्द महत्वपूर्ण हैं।

जिस व्यक्ति के विरुद्ध gesture या preparation किया गया है, उसका उस समय present होना आवश्यक है ताकि उसे criminal force के imminent use की apprehension हो सके।

Apprehension of Criminal Force

Victim को यह apprehension होना चाहिए कि accused criminal force use करने वाला है।

यहाँ Section 129 BNS महत्वपूर्ण है क्योंकि “criminal force” की definition वहीं दी गई है। इसलिए Sections 128, 129 और 130 को साथ पढ़ना चाहिए।

Actual Physical Contact Is Not Necessary

Section 130 का सबसे महत्वपूर्ण principle यह है कि actual physical contact या actual use of criminal force आवश्यक नहीं है

यदि accused केवल ऐसी preparation करता है जिससे victim को यह apprehension हो जाती है कि अभी उसे मारा या physically attacked किया जाएगा, तो assault हो सकता है।

इसलिए assault और criminal force में यही एक fundamental distinction है:

Assault: apprehension of imminent criminal force.

Criminal force: actual use of force with the additional statutory ingredients under Section 129.

Supreme Court ने भी पुराने IPC Sections 350 और 351 की इसी distinction को reaffirm किया है। B.N. John v. State of U.P., 2025 INSC 20 में Court ने स्पष्ट किया कि assault और criminal force के लिए specific acts और statutory ingredients आवश्यक हैं; केवल “disturbance” का सामान्य allegation पर्याप्त नहीं है। (Supreme Court App)

Section 130 के illustrations इसके practical application को बहुत स्पष्ट करते हैं।

Shaking Fist

A, Z की ओर अपनी fist shake करता है और उसका intention या knowledge है कि Z यह believe करे कि A उसे strike करने वाला है।

A ने Z पर assault किया है।

यहाँ A ने Z को वास्तव में मारा नहीं है। केवल fist shake करने से उत्पन्न apprehension पर्याप्त है।

Ferocious Dog

A एक ferocious dog के muzzle को खोलना शुरू करता है, इस intention या knowledge के साथ कि Z यह apprehend करे कि A dog को Z पर attack करने के लिए cause करने वाला है।

यह भी assault है।

यह illustration यह भी दिखाता है कि assault का gesture स्वयं direct physical attack होना आवश्यक नहीं है।

Stick and Threatening Words

A एक stick उठाकर Z से कहता है—“I will give you a beating.”

Section की Explanation के अनुसार words alone assault नहीं होते। लेकिन यहाँ words और gesture—stick उठाना—एक साथ मिलकर ऐसा meaning पैदा करते हैं जिससे Z को criminal force की apprehension हो सकती है।

इसलिए यह assault हो सकता है।

Mere Words Do Not Amount to Assault

Section 130 का Explanation विशेष रूप से कहता है:

Mere words do not amount to an assault.

लेकिन इसका यह अर्थ नहीं है कि words कभी assault के determination में relevant नहीं होते।

यदि words किसी gesture या preparation को ऐसा meaning देते हैं जिससे victim को apprehension हो कि criminal force अभी use किया जाएगा, तो words उस gesture/preparation को assault बनाने में relevant हो सकते हैं।

उदाहरण:

केवल A का कहना—“मैं तुम्हें मार दूँगा”—हर situation में Section 130 का assault नहीं बनाता।

लेकिन A यदि उसी समय stick उठाता है और कहता है—“मैं अभी तुम्हें मारता हूँ,” तो gesture + words मिलकर assault establish कर सकते हैं, facts के अनुसार।

Difference Between Assault and Threat

हर threat assault नहीं होता।

Section 130 में gesture या preparation के साथ ऐसा apprehension of imminent criminal force होना चाहिए कि accused अब criminal force use करने वाला है।

इसलिए future-oriented या vague threat और immediate threatening gesture में legal distinction हो सकता है।

उदाहरण के लिए, केवल किसी व्यक्ति को phone पर यह कहना कि “मैं बाद में तुम्हें देख लूँगा” Section 130 का assault automatically नहीं बनाता। लेकिन सामने उपस्थित होकर weapon-like object उठाकर तत्काल attack की apprehension पैदा करना facts के अनुसार assault हो सकता है।

Punishment for Assault

Section 130 स्वयं punishment prescribe नहीं करता। सामान्य assault की punishment Section 131 BNS में है।

Section 131 के अनुसार, जो व्यक्ति किसी व्यक्ति पर assault या criminal force करता है, और यह grave and sudden provocation के कारण नहीं है, उसे:

Imprisonment: imprisonment of either description up to 3 months

Fine: up to ₹1,000

या दोनों

हो सकते हैं।

Grave and Sudden Provocation

Section 131 में grave and sudden provocation का special treatment दिया गया है।

लेकिन Explanation 1 के अनुसार grave and sudden provocation punishment को mitigate नहीं करेगी यदि:

  • provocation offender ने स्वयं sought या voluntarily provoked की हो;

  • provocation law के obedience में किए गए act से आई हो;

  • provocation public servant द्वारा lawful exercise of power से आई हो; या

  • provocation lawful exercise of right of private defence से किए गए act से आई हो।

क्या provocation वास्तव में grave and sudden थी, यह question of fact है।

Nature of Offence

BNSS First Schedule के अनुसार सामान्य Section 131 offence:

Cognizable: No
Bailable: Yes
Trial: Any Magistrate

इस classification को aggravated/special forms of assault के साथ confuse नहीं करना चाहिए। उदाहरण के लिए woman को disrobe करने के intent से assault या criminal force under Section 76 अलग और अधिक गंभीर offence है।

Aggravated Forms of Assault

BNS में assault/criminal force के अलग circumstances के लिए specific provisions हैं:

Section 132

Public servant को उसके duty के execution में deter करने या prevent करने के लिए assault/criminal force।

Punishment: up to 2 years imprisonment, or fine, or both.

Section 132 BNS

Section 133

किसी व्यक्ति को dishonour करने के intent से assault/criminal force, otherwise than on grave and sudden provocation।

Punishment: up to 2 years imprisonment, or fine, or both.

Section 133 BNS

Section 134

किसी व्यक्ति द्वारा पहनी या carry की जा रही property की theft attempt में assault/criminal force।

Punishment: up to 2 years imprisonment, or fine, or both.

Section 135

किसी व्यक्ति को wrongfully confine करने के attempt में assault/criminal force।

Punishment: up to 1 year imprisonment, or fine up to ₹5,000, or both.

2025 INSC 20, Supreme Court of India

यह recent Supreme Court judgment Section 130 BNS को समझने के लिए महत्वपूर्ण है क्योंकि Court ने पुराने IPC Sections 350 और 351 की definitions को expressly consider किया।

Supreme Court ने स्पष्ट किया कि assault और criminal force अलग statutory concepts हैं और केवल “creating disturbance” जैसे vague allegations को बिना specific acts के assault या criminal force नहीं माना जा सकता। (Supreme Court App)

यह principle BNS Sections 129 और 130 पर भी relevant है क्योंकि BNS ने इन concepts को corresponding form में retain किया है।

Supreme Court ने इस case में IPC Sections 350 और 351 की statutory definitions पर विचार किया और criminal force तथा assault के बीच distinction को apply किया। यह judgment विशेष circumstances में दिया गया था, इसलिए इसे BNS Section 130 की definition समझने के लिए interpretative authority के रूप में देखना उचित है, न कि Section 130 BNS के direct case के रूप में।

Supreme Court ने IPC framework में assault और criminal force की statutory concepts पर चर्चा की। Court की reasoning से यह स्पष्ट होता है कि criminal force और assault के लिए statutory ingredients को अलग-अलग examine करना आवश्यक है।

BNS Section 130 की interpretation में यह judgment historical statutory context के रूप में उपयोगी है।

Section 130 and Right of Private Defence

Assault का concept right of private defence के context में भी महत्वपूर्ण है।

BNS Section 40 के अनुसार, body की private defence का right उस समय commence हो सकता है जब किसी offence के attempt या threat से body के संबंध में reasonable apprehension of danger arise हो, भले ही offence अभी committed न हुआ हो।

इसलिए assault और apprehension of criminal force की concepts private defence jurisprudence में भी महत्वपूर्ण भूमिका निभाती हैं।

Section 130 and Women-Related Offences

किसी woman के विरुद्ध assault या criminal force यदि specific sexual or gender-related intention के साथ किया जाता है, तो केवल Section 130 तक analysis सीमित नहीं रहेगा।

उदाहरण के लिए:

Section 74 BNS — woman की modesty outrage करने के intent/knowledge से assault या criminal force।

Section 76 BNS — woman को disrobe/naked करने के intent से assault या criminal force।

इन specific provisions में substantially higher punishment है।

Section 130 and Old IPC Section 351

BNS Section 130 का corresponding provision पुराने Section 351 IPC था।

IPC Section 351 में भी assault को gesture या preparation द्वारा ऐसी apprehension पैदा करने के रूप में define किया गया था कि accused criminal force use करने वाला है।

Supreme Court ने हाल के B.N. John judgment में इसी IPC Section 351 definition को reproduce किया और assault के लिए specific statutory conduct की आवश्यकता को reaffirm किया। (Supreme Court App)

इसलिए पुराने Section 351 IPC के Supreme Court precedents BNS Section 130 की interpretation में relevant रहेंगे, subject to statutory differences and factual context.
