Section 128 BNS 2023: Force – Meaning, Ingredients, Examples and Leading Supreme Court Judgments
Section 128 of the Bharatiya Nyaya Sanhita, 2023 (BNS) “Force” की legal definition देता है। यह स्वयं कोई punishment-creating provision नहीं है; बल्कि Section 129 (Criminal Force), Section 130 (Assault), Section 131 onward तथा अन्य offences में “force” की अवधारणा को समझने का आधार है।

Statutory Provision
Section 128 BNS के अनुसार, कोई व्यक्ति दूसरे व्यक्ति पर force का प्रयोग करता है, यदि वह उस दूसरे व्यक्ति में—
motion,
change of motion, या
cessation of motion
का कारण बनता है।
इसके अतिरिक्त, यदि वह किसी substance में ऐसी motion, change of motion या cessation of motion उत्पन्न करता है जिससे वह substance दूसरे व्यक्ति के शरीर के किसी भाग, उसके द्वारा पहनी या carry की जा रही वस्तु, अथवा ऐसी वस्तु के संपर्क में आता है जिससे उस व्यक्ति की sense of feeling प्रभावित होती है, तो भी “force” का प्रयोग माना जाता है।

Three Ways of Using Force
Section 128 में force के application के तीन तरीके बताए गए हैं:
By Own Bodily Power
पहला तरीका है अपने bodily power द्वारा किसी व्यक्ति में motion, change of motion या cessation of motion पैदा करना।
उदाहरण के लिए, A अपने हाथ से B को धक्का देता है और B का शरीर आगे की ओर move करता है। यहाँ A ने अपनी bodily power का इस्तेमाल करके B में motion उत्पन्न किया।

By Disposing Any Substance
दूसरा तरीका है किसी substance को इस प्रकार dispose करना कि उसके बाद किसी further act के बिना motion या change of motion हो जाए और उसका contact दूसरे व्यक्ति के शरीर अथवा उसकी wearing/carrying वस्तु से हो।
इसका अर्थ यह है कि force का प्रयोग हमेशा सीधे हाथ से करना आवश्यक नहीं है। किसी substance की movement के माध्यम से भी Section 128 का force constitute हो सकता है।

By Inducing an Animal
तीसरा तरीका है किसी animal को move करने, उसकी motion बदलने या उसे रोकने के लिए induce करना, जिसके परिणामस्वरूप दूसरे व्यक्ति पर Section 128 में contemplated effect पड़ता है।
इस प्रकार provision में animal-mediated force को भी expressly शामिल किया गया है।

Important Point: Force Is Not Necessarily Physical Touch
Section 128 की सबसे महत्वपूर्ण विशेषता यह है कि direct bodily contact हर situation में आवश्यक नहीं है।
यदि accused ऐसा act करता है जिससे किसी substance की movement के माध्यम से victim के शरीर या उसके द्वारा पहनी/carry की गई वस्तु पर ऐसा effect पड़ता है जिससे उसके sense of feeling पर प्रभाव पड़ता है, तो statutory definition के अनुसार force constitute हो सकता है।
Supreme Court ने पुराने IPC Section 349 की समान definition को interpret करते हुए Chandrika Sao v. State of Bihar में माना कि किसी public officer के हाथ से books छीनने पर officer के हाथ में jerk/motion उत्पन्न हुआ और उसके sense of feeling पर भी effect पड़ा; इसलिए वह “force” था। (CaseMine)

यह समझना अत्यंत महत्वपूर्ण है कि Section 128 अपने-आप में punishment prescribe नहीं करता।
यह केवल बताता है कि criminal law के लिए “force” क्या है। जब किसी दूसरे penal provision में “criminal force” या “assault” जैसी अवधारणा का application होता है, तब Section 128 की definition relevant होती है।

इसलिए हर force criminal force नहीं होता।

Difference Between Force and Assault
Section 130 BNS में assault अलग concept है।
Assault में मुख्य focus किसी gesture या preparation पर होता है जिससे उपस्थित व्यक्ति को यह apprehension हो कि उसके विरुद्ध criminal force use किया जाने वाला है। इसलिए actual physical force का होना assault के लिए आवश्यक नहीं होता।
इसके विपरीत Section 128 में actual motion, change of motion या cessation of motion का statutory concept महत्वपूर्ण है।

Section 128 की application में निम्न points महत्वपूर्ण हैं:

Accused के conduct से दूसरे व्यक्ति या relevant substance में motion उत्पन्न होना चाहिए।

उदाहरण के लिए, किसी moving object की speed या direction को इस प्रकार बदलना कि वह दूसरे व्यक्ति के शरीर या उसके द्वारा पहनी/carry की गई चीज से contact करे, facts के अनुसार Section 128 के ambit में आ सकता है।

किसी व्यक्ति या relevant substance की movement को रोकना भी definition में expressly included है।

जब substance के माध्यम से force use किया जाता है, तो statute उस contact को भी cover करता है जो victim के body, wearing/carrying वस्तु या ऐसी वस्तु से होता है जिससे victim की sense of feeling प्रभावित होती है।

यह Section 128 के लिए सबसे महत्वपूर्ण Supreme Court authorities में से एक है क्योंकि BNS Section 128 की language पुराने IPC Section 349 से लगभग समान है।
इस case में Assistant Superintendent of Commercial Taxes दुकान पर accounts inspect कर रहे थे। Accused ने उनके हाथ से account books snatch कर लीं।
Accused का argument था कि उसने officer के person पर force नहीं लगाया। Supreme Court ने इसे स्वीकार नहीं किया। Court ने reason किया कि books को snatch करने से officer के हाथ में jerk और motion उत्पन्न हुआ तथा hands की sense of feeling प्रभावित हुई। इसलिए यह IPC Section 349 के अर्थ में “force” था। (CaseMine)

Supreme Court ने unlawful assembly और rioting के context में IPC Section 349 की definition of force को consider किया। Court ने कहा कि rioting के लिए unlawful assembly द्वारा force या violence का use आवश्यक element है और “force” की statutory definition Section 349 IPC में दी गई थी। (indiankanoon.org)
क्योंकि BNS Section 128 ने force की मूल definition को carry forward किया है, यह judgment BNS framework में भी interpretative relevance रखता है।

Application in Rioting
पुराने IPC में Section 146 के अनुसार rioting तब होती थी जब unlawful assembly या उसका कोई member common object के prosecution में force या violence use करता था।
Supreme Court ने Lakshman Singh में स्पष्ट किया कि force/violence का element rioting के लिए आवश्यक है और force की statutory meaning Section 349 IPC से निर्धारित होती थी। (indiankanoon.org)
BNS में भी unlawful assembly और rioting से संबंधित provisions में “force or violence” की statutory relevance बनी हुई है। इसलिए Section 128 को केवल assault cases तक सीमित करके नहीं देखना चाहिए।

Force Through an Object
Section 128 का एक महत्वपूर्ण aspect indirect force है।
मान लीजिए A किसी ऐसी वस्तु को B की ओर इस तरह move करता है कि वह वस्तु B के शरीर से contact करे। यदि statutory conditions satisfy होती हैं, तो force का concept केवल इस आधार पर खत्म नहीं होगा कि A ने सीधे B को touch नहीं किया।
Chandrika Sao इसी principle का classic example है—books को सीधे officer के शरीर पर नहीं, बल्कि उसके हाथों से छीना गया था, फिर भी हाथ में motion और sense of feeling का effect होने के कारण Supreme Court ने force माना। (CaseMine)

Force Through an Animal
Section 128(c) expressly animal को भी cover करता है।
यदि कोई व्यक्ति किसी animal को इस प्रकार induce करता है कि वह दूसरे व्यक्ति की movement में change पैदा करे या उसके शरीर/संबंधित वस्तु के साथ statutory contact उत्पन्न करे, तो Section 128 की definition relevant हो सकती है।
इस provision का महत्व यह है कि criminal law में force केवल human hand-to-human body contact तक restricted नहीं है।

Relation with Section 129 BNS
Section 129 में criminal force के लिए Section 128 के force के अलावा additional ingredients आवश्यक हैं।
Section 129 के अनुसार force:
intentionally use किया गया हो;
किसी person पर use किया गया हो;
उस person की consent के बिना use किया गया हो; और
offence commit करने के उद्देश्य से, या injury, fear या annoyance cause करने की intention/knowledge के साथ use किया गया हो।
इसलिए prosecution को पहले यह establish करना पड़ सकता है कि conduct Section 128 में “force” है और उसके बाद Section 129 के additional ingredients establish करने होंगे। (India Kanoon)

Relation with Section 130 BNS
Section 130 assault से संबंधित है।
यहाँ एक महत्वपूर्ण distinction है:
Force: actual motion/change/cessation of motion या statutory contact का concept।
Criminal Force: force + intention/knowledge + absence of consent + statutory purpose।
Assault: gesture या preparation जिससे person को criminal force के imminent use की apprehension हो।
इस distinction को criminal force और assault से जुड़े आरोपों में charge framing तथा evidence appreciation के समय ध्यान में रखना आवश्यक है।
Sections 128–130 BNS
Is Section 128 Punishable Separately?
नहीं।
Section 128 केवल “Force” की definition देता है। इसमें कोई अलग imprisonment, fine या other punishment prescribed नहीं है।
Punishment उस substantive offence से आएगी जिसमें Section 128 का concept इस्तेमाल होता है—जैसे criminal force, assault, public servant को deter करने वाला offence आदि।

Section 128 and Old IPC Section 349
BNS Section 128 ने पुराने IPC Section 349 — Force के legal concept को largely carry forward किया है। India Code/eCourts material भी Section 128 को IPC Section 349 के corresponding provision के रूप में identify करता है। (IndiaCode by eCourtsIndia)
BNS 1 July 2024 से लागू हुआ। इसलिए 1 July 2024 के बाद किए गए conduct के लिए applicable substantive provision BNS Section 128 है, जबकि repeal-and-savings framework के कारण पुराने IPC के तहत पूर्व conduct के legal consequences अलग तरीके से governed हो सकते हैं। (India Code)
