Section 126 BNS 2023: Wrongful Restraint, Punishment, Ingredients and Supreme Court Judgments

Section 126 of the Bharatiya Nyaya Sanhita, 2023 (BNS) wrongful restraint अर्थात किसी व्यक्ति की उस दिशा में lawful movement को voluntarily obstruct करने से संबंधित है, जिसमें उसे जाने का अधिकार है। यह provision पुराने IPC Sections 339 और 341 के corresponding legal concept को BNS में एक ही Section में रखता है।

Statutory Provision

Section 126(1) BNS के अनुसार, जो व्यक्ति किसी व्यक्ति को voluntarily obstruct करता है ताकि वह उस direction में आगे न जा सके जिसमें उसे जाने का अधिकार है, वह उस व्यक्ति को wrongfully restrain करता है।

इस provision में एक महत्वपूर्ण Exception है। यदि land या water पर बने किसी private way को obstruct करने वाला व्यक्ति good faith में यह believe करता है कि उसे उस रास्ते को obstruct करने का lawful right है, तो ऐसा obstruction Section 126 के अर्थ में offence नहीं माना जाएगा।

Section 126(2) के अंतर्गत wrongful restraint के लिए simple imprisonment which may extend to one month, or fine which may extend to ₹5,000, or both का punishment है।

Meaning of Wrongful Restraint

Wrongful restraint का मूल अर्थ है—किसी व्यक्ति की उस दिशा में जाने की lawful freedom को obstruction द्वारा रोकना, जहाँ जाने का उसे अधिकार है।

यह आवश्यक नहीं है कि व्यक्ति को चारों तरफ से बंद कर दिया गया हो। यदि उसे केवल किसी particular direction में आगे जाने से रोका जाता है, तो facts के अनुसार Section 126 लागू हो सकता है।

उदाहरण के लिए, A किसी public रास्ते पर खड़े होकर Z को उस रास्ते से आगे जाने नहीं देता, जबकि Z को उस रास्ते से जाने का अधिकार है। यदि A का obstruction voluntary है और कोई statutory exception लागू नहीं होता, तो Section 126 attract हो सकता है। BNS स्वयं इसी प्रकार का illustration देता है।

Essential Ingredients

Section 126 के offence को establish करने के लिए निम्न ingredients महत्वपूर्ण हैं।

Voluntary Obstruction

सबसे पहले accused द्वारा obstruction होना चाहिए और वह obstruction voluntary होना चाहिए।

Supreme Court ने N.S. Madhanagopal & Anr. v. K. Lalitha, 2022 में पुराने IPC Section 341 के संदर्भ में तीन आवश्यक requirements बताई थीं—accused द्वारा obstruction, complainant को उस direction में जाने से रोकना जिसमें उसे right था, और obstruction का voluntary होना। Court ने यह भी कहा कि obstructor को यह intend, know या reason to believe होना चाहिए कि अपनाया गया means complainant को obstruct करेगा।

Right to Proceed

जिस व्यक्ति को रोका गया है, उसका उस particular direction में proceed करने का legal right होना आवश्यक है।

यह Section 126 का सबसे महत्वपूर्ण ingredient है। केवल यह allegation कि “मुझे रास्ते में रोक दिया गया” पर्याप्त नहीं है; यह भी establish होना चाहिए कि complainant को उस direction में आगे जाने का अधिकार था।

State of West Bengal, 2025 INSC 1373 में Supreme Court ने इसी requirement को स्पष्ट रूप से दोहराया। Court ने कहा कि wrongful restraint establish करने के लिए complainant का उस direction में proceed करने का right और obstruct करने वाले के पास lawful right का अभाव महत्वपूर्ण है।

Causal Connection Between Obstruction and Prevention

Accused का act ऐसा होना चाहिए जिससे complainant वास्तव में उस direction में proceed न कर सके।

अर्थात केवल आरोपी का वहाँ उपस्थित होना या कोई disagreement होना अपने-आप wrongful restraint नहीं बनाता। Obstruction और prevention of movement के बीच factual connection होना चाहिए।

Exception Under Section 126

Section 126 में private way से संबंधित specific Exception दिया गया है।

यदि:

  • रास्ता private way over land or water है;

  • accused ने उसे obstruct किया है;

  • accused good faith में believe करता था कि उसे ऐसा obstruction करने का lawful right है,

तो ऐसा obstruction Section 126 के अंतर्गत offence नहीं होगा।

इसलिए property या pathway dispute में Court केवल obstruction देखकर criminal liability निर्धारित नहीं करेगी; accused के alleged lawful right और good-faith belief को भी facts के अनुसार examine किया जाएगा।

Punishment

Section 126(2) के तहत punishment है:

इसमें कोई statutory minimum imprisonment prescribed नहीं है।

Cognizable and Bailable Nature

BNSS First Schedule के अनुसार Section 126(2) का offence cognizable और bailable category में आता है तथा इसका trial Magistrate के समक्ष होता है।

इसलिए Section 126 के मामले में accused को bailable offence के रूप में bail का statutory framework उपलब्ध होता है। BNSS में cognizable offence का अर्थ भी ऐसा offence है जिसमें police officer First Schedule अथवा अन्य applicable law के अनुसार warrant के बिना arrest कर सकता है।

Wrongful Restraint and Wrongful Confinement

Section 126 और Section 127 के बीच distinction अत्यंत महत्वपूर्ण है।

Wrongful restraint — Section 126: व्यक्ति को किसी particular direction में जाने से रोका जाता है, जबकि उस direction में जाने का उसे अधिकार है।

Wrongful confinement — Section 127: व्यक्ति को ऐसी सीमाओं के भीतर restrain किया जाता है कि वह उन circumscribing limits से बाहर नहीं जा सकता।

BNS में Section 127 स्वयं wrongful confinement को ऐसे restraint के रूप में describe करता है जिसमें व्यक्ति को certain circumscribing limits से बाहर जाने से prevent किया जाता है।

उदाहरण के लिए, किसी व्यक्ति को सड़क पर आगे जाने से रोकना facts के अनुसार wrongful restraint हो सकता है; लेकिन किसी व्यक्ति को कमरे में बंद करके उसके बाहर निकलने के सभी रास्ते रोक देना wrongful confinement की ओर जाता है।

Wrongful Restraint and Property Disputes

Section 126 का application property और pathway disputes में विशेष रूप से महत्वपूर्ण हो सकता है।

यदि किसी व्यक्ति को किसी property में enter करने से रोका गया है, तो केवल इतना तथ्य Section 126 को automatically establish नहीं करता। यह देखना होगा कि complainant के पास उस property या particular direction में जाने का legal right था या नहीं।

Tuhin Kumar Biswas @ Bumba v. State of West Bengal, 2025 INSC 1373 में complainant ने property में प्रवेश करने का दावा किया था। Supreme Court ने record में उसके tenancy/right to enter को establish करने वाला पर्याप्त material नहीं पाया और wrongful restraint के आवश्यक ingredients को ध्यान में रखते हुए proceedings को sustain नहीं किया।

Leading Supreme Court Judgments

N.S. Madhanagopal & Anr. v. K. Lalitha

Criminal Appeal No. 1759 of 2022, decided on 10 October 2022

यह Supreme Court का महत्वपूर्ण judgment है जिसमें IPC Section 341 के संदर्भ में wrongful restraint के ingredients को स्पष्ट किया गया।

Court ने बताया कि prosecution को establish करना होगा:

  • accused द्वारा obstruction;

  • उस obstruction के कारण व्यक्ति को उस direction में जाने से रोकना जिसमें उसे right to proceed था; और

  • accused द्वारा obstruction voluntary रूप से करना।

Supreme Court ने इन्हीं आवश्यक ingredients के अभाव में criminal proceedings quash कर दीं।

यह reasoning BNS Section 126 के statutory language के साथ सीधे relevant है क्योंकि BNS में भी voluntary obstruction और right to proceed दोनों central requirements हैं।

Tuhin Kumar Biswas @ Bumba v. State of West Bengal

2025 INSC 1373, Supreme Court

यह Section 126 के लिए वर्तमान समय की अत्यंत महत्वपूर्ण authority है। मामला IPC Sections 341, 354C और 506 से संबंधित था।

Supreme Court ने wrongful restraint के लिए यह principle reaffirm किया कि complainant को उस direction में जाने का right होना चाहिए और alleged obstructor के पास obstruction करने का lawful right नहीं होना चाहिए। Court ने उपलब्ध material के आधार पर पाया कि complainant का property में प्रवेश करने का legal right पर्याप्त रूप से स्थापित नहीं हुआ था।

BNS Section 126 की language भी इसी basic formulation को अपनाती है।

(2009) 6 SCC 475

यह Supreme Court authority wrongful restraint के statutory ingredients को समझने में उपयोगी है। इसमें Court ने IPC Section 339 के context में obstruction और उस व्यक्ति के right to proceed की requirement पर विचार किया था।

चूँकि BNS Section 126 में wrongful restraint की मूल statutory formulation जारी रखी गई है, यह judgment interpretative reference के रूप में महत्वपूर्ण है।

Practical Examples

Example of Wrongful Restraint

A किसी व्यक्ति Z को उस public रास्ते पर आगे जाने से रोक देता है जिस पर Z को जाने का lawful right है। A के पास Z को रोकने का कोई lawful right नहीं है और obstruction voluntary है।

ऐसे facts में Section 126 का offence बन सकता है।

Example Where Right to Proceed Is Not Established

यदि A किसी property के entrance पर Z को रोकता है, लेकिन Z यह establish नहीं कर पाता कि उसे उस property में प्रवेश करने या उस direction में proceed करने का legal right था, तो केवल obstruction का allegation Section 126 के offence को स्वतः establish नहीं करेगा।

Private Way Example

यदि A किसी private pathway को रोकता है और facts से यह सामने आता है कि A ने good faith में believe किया था कि उसे उस pathway को obstruct करने का lawful right है, तो statutory Exception लागू हो सकता है।

Difference Between Section 126 and Section 221 BNS

Section 126 any person की wrongful restraint से संबंधित है।

इसके विपरीत, Section 221 BNS में public servant को उसके public functions के discharge में voluntarily obstruct करना अलग offence है। इसलिए यदि obstruction का victim public servant है और act उसके public functions के discharge में किया गया है, तो Section 221 की applicability भी facts के अनुसार examine करनी होगी।

Key Legal Principles

Section 126 BNS को apply करते समय निम्न principles महत्वपूर्ण हैं:

Right to proceed — complainant को उस direction में जाने का legal right होना चाहिए।

Voluntary obstruction — accused का obstruction voluntary होना चाहिए।

Actual prevention — obstruction ने व्यक्ति को उस direction में proceeding से prevent किया हो।

Lawful right of accused — accused के पास obstruction करने का lawful right है या नहीं, यह facts के आधार पर देखा जाएगा।

Good-faith exception — private way over land or water के मामले में statutory Exception उपलब्ध है, यदि accused good faith में lawful right believe करता था।

पुराने IPC में wrongful restraint दो provisions में था:

Section 339 IPC — wrongful restraint की definition।

Section 341 IPC — wrongful restraint की punishment।

BNS में इन दोनों concepts को Section 126 के अंतर्गत रखा गया है। इसलिए पुराने IPC judgments, विशेषकर wrongful restraint के ingredients से संबंधित Supreme Court judgments, BNS Section 126 की interpretation में relevant हो सकते हैं, जब तक BNS language या context में कोई substantive difference न हो।

Conclusion

Section 126 BNS में wrongful restraint का मुख्य आधार voluntary obstruction + right to proceed + prevention of movement है। केवल किसी व्यक्ति को रोकने का allegation पर्याप्त नहीं है; complainant का उस direction में जाने का legal right और accused का voluntary obstruction establish करना आवश्यक है। Supreme Court के N.S. Madhanagopal (2022) और Tuhin Kumar Biswas (2025 INSC 1373) judgments इस principle को स्पष्ट रूप से support करते हैं।

Section 126(2) में simple imprisonment up to one month, fine up to ₹5,000, or both का punishment है।
