Section 168 BNS, 2023: Wearing Garb or Carrying Token Used by Soldier, Sailor or Airman

Section 168 of the Bharatiya Nyaya Sanhita, 2023 military personnel की पहचान या authority का झूठा impression उत्पन्न करने वाले dress, uniform या token के fraudulent use से संबंधित है। इसका उद्देश्य यह रोकना है कि कोई गैर-सैनिक व्यक्ति स्वयं को Soldier, Sailor या Airman के रूप में प्रस्तुत करके लोगों को भ्रमित करे।

Statutory Provision

“Whoever, not being a soldier, sailor or airman in the Army, Naval or Air service of the Government of India, wears any garb or carries any token resembling any garb or token used by such a soldier, sailor or airman with the intention that it may be believed that he is such a soldier, sailor or airman, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to two thousand rupees, or with both.”

Meaning of Section 168

Section 168 में केवल किसी military uniform जैसी dress पहन लेना अपने-आप में sufficient नहीं है।

Provision में एक महत्वपूर्ण mens rea requirement है:

“with the intention that it may be believed that he is such a soldier, sailor or airman”

अर्थात prosecution को यह establish करना होगा कि व्यक्ति ने ऐसी garb या token इस intention से पहना/carry किया कि लोगों को यह विश्वास हो सके कि वह वास्तव में Army, Navy या Air Force का soldier, sailor अथवा airman है।

Essential Ingredients

Section 168 के मुख्य ingredients इस प्रकार हैं:

Punishable conduct	उपर्युक्त elements के साथ act किया गया हो

इन सभी elements को साथ पढ़ना आवश्यक है।

“Not Being a Soldier, Sailor or Airman”

Section 168 की शुरुआत ही इस limitation से होती है:

“Whoever, not being a soldier, sailor or airman…”

इसका अर्थ है कि provision का target ऐसा व्यक्ति है जो स्वयं Government of India की Army, Naval या Air service में soldier, sailor या airman नहीं है।

इसलिए genuine military personnel द्वारा अपनी authorized service garb पहनना Section 168 के mischief में नहीं आता।

Garb or Token

Provision दो प्रकार की चीजों को cover करता है:

Garb

Garb का सामान्य अर्थ ऐसा dress या attire है जिससे व्यक्ति की military identity का impression बन सकता है।

Token

Token कोई ऐसा identifying item/sign हो सकता है जो military personnel की पहचान से associated हो।

लेकिन केवल similarity पर्याप्त नहीं है। Section 168 में intention to create belief of military identity भी आवश्यक है।

Intention is the Key Element

Section 168 का सबसे महत्वपूर्ण हिस्सा है:

“with the intention that it may be believed that he is such a soldier, sailor or airman”

इसलिए किसी costume party, theatrical performance या सामान्य fashion में military-style clothing का उपयोग और Section 168 के अंतर्गत criminal liability का प्रश्न facts तथा intention पर निर्भर करेगा।

Section 168 and Mere Resemblance

यह distinction अत्यंत महत्वपूर्ण है।

Mere resemblance ≠ automatically offence

Statutory language में resemblance के साथ यह भी आवश्यक है कि व्यक्ति ने उस garb/token को इस intention से use किया हो कि उसे Soldier, Sailor या Airman समझा जाए।

इसलिए prosecution को केवल यह establish करना पर्याप्त नहीं होगा कि clothing military uniform जैसी दिखती थी। उसे statutory intention भी establish करना होगा।

Punishment

Section 168 के अंतर्गत तीन alternative forms of punishment हैं:

अर्थात Court facts के अनुसार imprisonment, fine अथवा दोनों impose कर सकता है।

Section 167 vs Section 168

दोनों provisions को confuse नहीं करना चाहिए।

Section 168 vs Personation

Section 168 और किसी अन्य personation-related offence के बीच factual overlap संभव हो सकता है, लेकिन Section 168 का statutory focus specifically military identity का impression पैदा करने के लिए garb या token का use है।

इसलिए Section 168 में तीन चीजें विशेष रूप से देखी जाएंगी:

एक व्यक्ति Army personnel का ऐसा uniform/token पहनता है जो वास्तविक military garb से substantially resembles करता है और वह जानबूझकर लोगों के सामने इस प्रकार उपस्थित होता है कि वे उसे Army personnel समझें।

यह Section 168 के statutory ingredients की ओर संकेत करता है।

Example — Intention absent

कोई व्यक्ति किसी dramatic performance के लिए military-style costume पहनता है, लेकिन facts से यह establish नहीं होता कि उसका उद्देश्य लोगों को उसे वास्तविक soldier, sailor या airman समझाना था।

ऐसी स्थिति में Section 168 का intention element महत्वपूर्ण प्रश्न बनेगा।

Relationship with Section 167

Section 167 और Section 168 का sequence भी meaningful है।

Section 167 military Acts के अधीन persons के लिए Chapter VIII के offences के संबंध में exclusion देता है, जबकि Section 168 उसके बाद ऐसे व्यक्ति के conduct को punish करता है जो वास्तविक soldier, sailor या airman न होते हुए military garb या token का deceptive use करता है।

Corresponding Provision under the Earlier IPC

Section 168 BNS का subject-matter पुराने Indian Penal Code, 1860 के Section 140 से corresponding है—wearing garb or carrying token used by soldier, sailor or airman।

BNS ने इस offence की basic statutory structure को बनाए रखा है, जबकि Section 168 में prescribed fine ₹2,000 तक है।

पुराने IPC provision से तुलना करते समय वर्तमान BNS text को primary statutory reference माना जाना चाहिए।

Supreme Court Judgments

Section 168 BNS पर कोई प्रत्यक्ष और leading Supreme Court judgment उपलब्ध statutory material में identified नहीं है। इसलिए किसी Supreme Court case को Section 168 की direct authoritative interpretation के रूप में प्रस्तुत करना उचित नहीं होगा।

इस provision का interpretation मुख्यतः उसके express statutory elements—विशेषकर resemblance और intention that it may be believed—के आधार पर किया जाएगा।

General criminal law में mens rea और statutory intention के सिद्धांतों पर Supreme Court के अनेक judgments हैं, लेकिन उन्हें Section 168 का direct precedent बताना सही नहीं होगा।
