Section 167 BNS, 2023: Exclusion of Persons Subject to Military Service Laws

Section 167 of the Bharatiya Nyaya Sanhita, 2023 Chapter VIII—“Of Offences Relating to the Army, Navy and Air Force”—में यह स्पष्ट करता है कि जिन व्यक्तियों पर संबंधित सैन्य कानून लागू होते हैं, उन्हें उसी Chapter के offences के लिए BNS के अंतर्गत भी अलग से punish नहीं किया जाएगा।

Statutory Provision

उपलब्ध BNS पाठ में Section 167 इस प्रकार दिया गया है:

“No person subject to the Air Force Act, 1950, the Army Act, 1950 and the Navy Act, 1957, or shall be subject to punishment under this Sanhita for any of the offences defined in this Chapter.”

Object of Section 167

Section 167 का मूल उद्देश्य overlapping punishment को रोकना है।

Chapter VIII में Army, Navy और Air Force से संबंधित offences जैसे—

  • mutiny के लिए abetment,

  • superior officer पर assault के लिए abetment,

  • desertion के लिए abetment,

  • deserter को harbour करना,

  • merchant vessel में deserter को छिपाना,

  • insubordination के लिए abetment,

आदि का प्रावधान है।

लेकिन यदि कोई व्यक्ति स्वयं Air Force Act, 1950, Army Act, 1950 या Navy Act, 1957 के अधीन subject/person है, तो Section 167 यह व्यवस्था करता है कि उसे इस Sanhita के Chapter VIII में defined offences के लिए BNS के अंतर्गत punishment नहीं दिया जाएगा।

अर्थात Section 167 का focus offence को define करना नहीं, बल्कि BNS और special military legislation के बीच applicability का exclusion निर्धारित करना है।

Why Military Acts Matter

Important Legal Principle

Section 167 को केवल यह कहकर नहीं समझना चाहिए कि “military personnel पर BNS लागू ही नहीं होता।”

यह उससे अधिक सीमित provision है।

इसका statutory focus है:

“any of the offences defined in this Chapter”

अर्थात exclusion विशेष रूप से इस Chapter में defined offences के संबंध में है।

इसलिए Section 167 को BNS के प्रत्येक offence से blanket immunity के रूप में पढ़ना उचित नहीं होगा।

Example

मान लीजिए कोई व्यक्ति Army Act, 1950 के अधीन subject है और उसके विरुद्ध ऐसा conduct alleged है जो BNS Chapter VIII के किसी offence के elements को पूरा करता है।

Section 167 के कारण केवल इस आधार पर कि conduct BNS Chapter VIII में भी defined है, उसे उसी Chapter के तहत BNS punishment नहीं दिया जाएगा।

Section 167 and General Criminal Liability

यह distinction महत्वपूर्ण है कि Section 167 को general immunity from criminal liability नहीं माना जाना चाहिए।

Provision का language Chapter VIII के offences तक सीमित है। इसलिए किसी अलग BNS offence या किसी अन्य applicable law की liability का प्रश्न अलग provisions के अनुसार निर्धारित होगा।

उदाहरण के लिए, केवल इसलिए कि कोई व्यक्ति Army Act के अधीन है, इससे यह निष्कर्ष स्वतः नहीं निकलता कि BNS के प्रत्येक offence से वह बाहर हो जाता है।
