Section 154 BNS 2023: Committing Depredation on Territories of a Foreign State at Peace with India
BNS Section 154 भारत के साथ शांति में रहने वाले किसी foreign State के territory पर depredation करने या उसकी तैयारी करने को अपराध बनाता है।
इस offence का उद्देश्य friendly foreign State के territorial sovereignty और India के international relations को criminal-law protection देना है। [BNS s.154]
Statutory Provision
BNS Section 154 provides:
“Whoever commits depredation, or makes preparations to commit depredation, on the territories of any foreign State at peace with the Government of India…”
ऐसे व्यक्ति को imprisonment up to 7 years, fine तथा certain property की forfeiture का दंड दिया जा सकता है। [BNS s.154]

Meaning of Depredation
“Depredation” का सामान्य legal sense है—किसी territory में लूट, हिंसात्मक plunder, destruction या property पर predatory attack करना। Section 154 केवल completed depredation तक सीमित नहीं है; preparation to commit depredation भी expressly punishable है।
इसलिए provision की structure इस प्रकार है:

Essential Ingredients
Section 154 के मुख्य ingredients को इस table से समझा जा सकता है:

Foreign State at Peace with India
यह Section तभी लागू होता है जब संबंधित foreign State Government of India के साथ peace में हो।
इस phrase का महत्व इसलिए है क्योंकि Section 154 ordinary property offence नहीं है। इसका focus किसी foreign State के territory पर ऐसा conduct है जिसका international/public character है।
इसलिए किसी व्यक्ति द्वारा foreign country में किया गया हर theft, robbery या property offence automatically Section 154 नहीं बनेगा। Prosecution को Section में prescribed depredation + foreign State at peace with India + territorial nexus establish करना होगा। [BNS s.154]
Waging War vs Depredation
Section 153 और Section 154 को अलग-अलग समझना अत्यंत महत्वपूर्ण है।

अर्थात Section 153 का primary focus war against the Government है, जबकि Section 154 का focus territory पर depredation है।
Preparation is Also Punishable
Section 154 की एक महत्वपूर्ण विशेषता यह है कि offence केवल तब नहीं बनता जब depredation वास्तव में हो जाए।
Statutory wording expressly कहती है:
“commits depredation”
OR
“makes preparations to commit depredation”
इसका अर्थ है कि legislature ने completed depredation और उसकी legally relevant preparation दोनों को provision के ambit में रखा है। [BNS s.154]
हालाँकि “preparation” और mere intention को एक ही नहीं माना जाना चाहिए। किसी व्यक्ति का केवल मन में अपराध करने का विचार सामान्यतः preparation के बराबर नहीं होता; prosecution को ऐसी concrete circumstances दिखानी होंगी जो statutory preparation को establish करें।

Section 154 में punishment काफी गंभीर है:

Forfeiture उन properties के संबंध में है जो depredation करने में used/intended to be used थीं या depredation से acquired हुई थीं। [BNS s.154]
इसलिए property forfeiture Section 154 का केवल incidental consequence नहीं बल्कि statutory punishment framework का expressly stated हिस्सा है।

Property Forfeiture
Section 154 में तीन प्रकार की property विशेष रूप से relevant हो सकती है:

इन circumstances में statutory forfeiture का provision लागू हो सकता है। [BNS s.154]
यह aspect Section 154 को ordinary theft या robbery provisions से अलग बनाता है, क्योंकि यहाँ property consequence को expressly foreign-state depredation के context में attach किया गया है।
Section 154 and IPC Section 126
BNS Section 154 broadly corresponds to IPC Section 126.
पुराने IPC Section 126 में provision था:
“Whoever commits depredation, or makes preparation to commit depredation…”
और punishment भी up to seven years, fine and forfeiture थी। (IndiaCode by eCourtsIndia)
लेकिन BNS ने wording में महत्वपूर्ण drafting change किया है।

BNS ने पुराने expression “Power in alliance or at peace” को हटाकर “foreign State at peace with the Government of India” किया है। इसलिए BNS terminology अधिक contemporary और geographically neutral है। (IndiaCode by eCourtsIndia)
Supreme Court Position
Section 154 BNS पर अभी कोई ऐसा leading Supreme Court judgment identified नहीं है जो BNS Section 154 की ingredients को directly interpret करता हो।
इसलिए IPC Section 126 के पुराने authorities को automatically BNS Section 154 का direct precedent कहना उचित नहीं होगा।
इसके अलावा, उपलब्ध reported Supreme Court jurisprudence में IPC Section 126 पर substantive interpretation अत्यंत सीमित दिखाई देती है। इसलिए इस provision पर article लिखते समय unrelated Supreme Court cases को “leading Section 154 judgments” के रूप में प्रस्तुत करना doctrinally सही नहीं होगा।
Important distinction: Supreme Court के “waging war” cases—जैसे State (NCT of Delhi) v. Navjot Sandhu @ Afsan Guru—Section 121 IPC से संबंधित थे। वे “waging war” की jurisprudence के लिए relevant हैं, लेकिन Section 154 BNS के direct precedent नहीं हैं।
Section 154 and Section 155
Section 155, Section 154 से closely connected है।
Section 155 उस व्यक्ति को punish करता है जो जानते हुए ऐसी property receive करता है जो Sections 153 या 154 के offence में ली गई हो। इसके लिए up to 7 years imprisonment, fine और received property की forfeiture का provision है। [BNS s.155]
इसका statutory chain इस प्रकार है:

इसलिए Section 155 में knowledge का element विशेष रूप से महत्वपूर्ण है। [BNS ss.154–155]
Practical Examples
Example:
भारत के साथ peace में रहने वाले foreign State के territory में कोई व्यक्ति organised armed group के साथ जाकर वहाँ property को violently plunder करता है। Facts यदि statutory “depredation” को establish करते हैं, तो Section 154 potentially attracted हो सकता है।
Preparation Example:
यदि व्यक्ति depredation करने के लिए concrete preparations करता है, लेकिन actual depredation complete नहीं होती, तब भी Section 154 का express “makes preparations” limb relevant हो सकता है। [BNS s.154]
Ordinary Foreign Crime:
किसी foreign country में सामान्य theft या private property dispute को केवल इसलिए Section 154 नहीं माना जा सकता कि वह foreign territory में हुआ है। Statutory ingredients specifically establish करना आवश्यक है।
