Protection of Women from Domestic Violence Act, 2005 की धारा 18 Magistrate को घरेलू हिंसा से पीड़ित महिला के पक्ष में Protection Order पारित करने की शक्ति देती है। इसका उद्देश्य respondent को domestic violence करने, उसमें सहायता करने, महिला से संपर्क करने, उसके workplace में प्रवेश करने, assets को alienate करने तथा अन्य specified acts से रोककर महिला को प्रभावी सुरक्षा प्रदान करना है। [DV Act, 2005, s.18]

धारा 18 का मूल उद्देश्य

Section 18 Chapter IV — Procedure for Obtaining Orders of Reliefs का पहला substantive protective relief है। Section 17 महिला को shared household में रहने का अधिकार देता है, जबकि Section 18 उसे domestic violence से protective judicial restraint प्रदान करता है। [DV Act, 2005, ss.17–18]

Section 18 का protection order केवल physical violence को रोकने तक सीमित नहीं है। इसके clauses communication, workplace/school access, property/assets, stridhan, dependants और अन्य specified acts तक विस्तृत हैं। [DV Act, 2005, s.18]

Protection Order कौन पारित कर सकता है

Protection Order Magistrate द्वारा पारित किया जाता है।

Section 27 के अनुसार competent Court Judicial Magistrate First Class या Metropolitan Magistrate है, जिसके local jurisdiction में aggrieved person permanently या temporarily रहती है, business करती है या employed है; respondent रहता, business करता या employed है; अथवा cause of action arise हुआ है। [DV Act, 2005, s.27]

Protection Order के लिए दो आवश्यक Judicial Conditions

Section 18 के अनुसार Magistrate Protection Order तभी पारित करता है जब:

aggrieved person और respondent को opportunity of being heard दी गई हो, और

Magistrate prima facie satisfied हो कि domestic violence हुई है या उसके होने की संभावना है।

[DV Act, 2005, s.18]

यहाँ “prima facie” का अर्थ यह है कि इस stage पर Court को final trial की तरह प्रत्येक allegation को conclusively prove करना आवश्यक नहीं है। Court के सामने उपलब्ध material से domestic violence होने या likely होने का prima facie आधार होना चाहिए।

धारा 18(a) — Domestic Violence करने से रोकना

Magistrate respondent को किसी भी act of domestic violence को commit करने से prohibit कर सकता है। [DV Act, 2005, s.18(a)]

Section 3 में domestic violence का व्यापक definition दिया गया है, जिसमें:

physical abuse

sexual abuse

verbal and emotional abuse

और

economic abuse

शामिल हैं। [DV Act, 2005, s.3]

इसलिए Section 18(a) के तहत protection order केवल मारपीट रोकने तक सीमित नहीं है।

धारा 18(b) — Aiding या Abetting पर रोक

Magistrate respondent को domestic violence की commission में:

aiding

या

abetting

से भी prohibit कर सकता है। [DV Act, 2005, s.18(b)]

इसका उद्देश्य केवल direct perpetrator को रोकना नहीं, बल्कि domestic violence को facilitate करने वाले conduct को भी restrain करना है।

धारा 18(c) — Workplace या अन्य स्थान में प्रवेश पर रोक

Magistrate respondent को aggrieved person के:

place of employment

में प्रवेश करने से रोक सकता है।

यदि aggrieved person child है, तो respondent को उसके:

school

या

अन्य frequently visited place

में प्रवेश करने से भी prohibit किया जा सकता है। [DV Act, 2005, s.18(c)]

यह provision domestic violence के प्रभाव को घर की चारदीवारी से बाहर तक recognise करता है।

धारा 18(d) — Communication पर रोक

Magistrate respondent को aggrieved person से किसी भी form में communication attempt करने से रोक सकता है। [DV Act, 2005, s.18(d)]

Provision communication के कई forms को expressly recognise करता है:

Personal contact

Oral communication

Written communication

Electronic communication

Telephonic communication

इसलिए Section 18(d) का scope केवल telephone calls तक सीमित नहीं है।

यदि protection order communication को prohibit करता है, तो respondent द्वारा prohibited communication का कोई भी specified form order का उल्लंघन बन सकता है।

धारा 18(e) — Assets और Bank Accounts की Protection

Magistrate respondent को बिना Magistrate की leave के निम्न assets से संबंधित acts करने से रोक सकता है:

assets को alienate करना

bank locker operate करना

bank account operate करना

जब assets या accounts:

दोनों parties द्वारा jointly held/used/enjoyed हों,

या aggrieved person और respondent jointly held हों,

या respondent singly hold करता हो,

और इसमें aggrieved person's stridhan भी शामिल है।

[DV Act, 2005, s.18(e)]

यह provision economic abuse और property-related deprivation से protection प्रदान करता है।

Stridhan की विशेष Protection

Section 18(e) में stridhan का express mention अत्यंत महत्वपूर्ण है। [DV Act, 2005, s.18(e)]

यदि stridhan या अन्य property respondent के control में है, तो circumstances के अनुसार Magistrate alienation या other prohibited dealing को restrain कर सकता है।

Rules के Form IV में भी aggrieved woman को stridhan, jewellery, clothes, articles of daily use और household goods वापस प्राप्त करने के अधिकार की जानकारी देने का प्रावधान है।

Section 19(8) के तहत Magistrate respondent को stridhan या ऐसी property/valuable security वापस करने का direction भी दे सकता है जिस पर aggrieved person entitled है।

इसलिए Section 18(e) और Section 19(8) को साथ पढ़ना महत्वपूर्ण है।

धारा 18(f) — Dependants और Helpers की Protection

Magistrate respondent को:

dependants

other relatives

या

ऐसे किसी व्यक्ति को जो aggrieved person को domestic violence से assistance देता है

हिंसा करने से रोक सकता है। [DV Act, 2005, s.18(f)]

यह provision महत्वपूर्ण protective extension प्रदान करता है।

यदि respondent महिला के किसी relative, child, dependant या assistance provider को target करता है ताकि महिला पर दबाव बनाया जा सके, तो Section 18(f) के तहत appropriate protection order की मांग की जा सकती है।

धारा 18(g) — अन्य Protective Directions

Section 18(g) Magistrate को respondent को “committing any other act as specified in the protection order” से prohibit करने की power देता है। [DV Act, 2005, s.18(g)]

यह residual clause है।

इससे Court को case-specific protective directions देने की flexibility मिलती है, बशर्ते direction statutory protection order के framework में हो।

Protection Order केवल Negative Restraint नहीं

Section 18 के अधिकांश clauses respondent को कुछ करने से prohibit करते हैं।

लेकिन Rules का Form IV Protection Order के practical content को विस्तृत रूप में दर्शाता है। इसमें:

domestic violence रोकना

residence/workplace से दूर रहना

contact न करना

child के school से दूर रहना

firearms/weapons surrender करना

dangerous substances से दूर रहना

और

alcohol/drugs का सेवन रोकना

जैसे protective measures का उल्लेख है।

इससे स्पष्ट होता है कि Protection Order case-specific safety requirements को ध्यान में रखकर तैयार किया जा सकता है।

Rule 8 — Safety Plan और Section 18

Protection of Women from Domestic Violence Rules, 2006 का Rule 8(1)(iv) Protection Officer को aggrieved person के साथ consultation करके Form V में Safety Plan तैयार करने का duty देता है।

Safety Plan में:

violence का प्रकार

उसके consequences

future violence की apprehension

required safety measures

और

Court से मांगे गए orders

का विवरण दिया जा सकता है। [DV Rules, 2006, Rule 8(1)(iv)]

इसलिए Section 18 की protection मांगते समय Safety Plan practical evidentiary/procedural assistance प्रदान कर सकता है।

Form IV में Section 18 की जानकारी

Rules का Form IV aggrieved person को उसके rights और available remedies की information देने के लिए prescribed है।

इसमें Section 18 के अंतर्गत:

महिला और उसके बच्चों को domestic violence से protection

particular dangers/insecurities के विरुद्ध protective measures

और

respondent द्वारा contact/communication रोकने

जैसे rights बताए गए हैं।

इससे Section 18 की protective scope को समझने में सहायता मिलती है।

Section 18 और Section 23 — Interim Protection Order

Section 18 final/protective order के framework में है, जबकि Section 23 Magistrate को interim और ex parte orders देने की power देता है।

Section 23(1) के अनुसार Magistrate proceedings के दौरान ऐसा interim order pass कर सकता है जिसे वह just and proper समझता है।

Section 23(2) में यदि application prima facie domestic violence या उसकी likelihood disclose करती है, तो Magistrate aggrieved person के prescribed affidavit के आधार पर ex parte order भी pass कर सकता है। [DV Act, 2005, s.23]

इसलिए immediate danger की स्थिति में Section 18 की protection को Section 23 के interim/ex parte mechanism के माध्यम से तत्काल judicial protection मिल सकती है।

Section 18 और Section 19 में अंतर

यह distinction अत्यंत महत्वपूर्ण है।

Section 18 — Protection Order

मुख्यतः respondent को domestic violence और specified acts से restrain करता है।

Section 19 — Residence Order

मुख्यतः shared household में residence और possession से संबंधित directions देता है।

हालांकि दोनों remedies facts के अनुसार एक ही case में साथ-साथ दी जा सकती हैं।

Section 18 और Section 20 में अंतर

Section 18 protective restraint है।

Section 20 monetary relief है।

Section 20 के तहत Magistrate domestic violence के कारण aggrieved person और child द्वारा suffered expenses/losses को meet करने के लिए monetary relief दे सकता है। इसमें loss of earnings, medical expenses, property loss/damage और maintenance शामिल हो सकते हैं। [DV Act, 2005, s.20]

इसलिए maintenance order को सामान्यतः Section 20 के framework में समझना चाहिए, जबकि Section 18 का principal character protection/restraint है।

Section 18 और Section 22 में अंतर

Section 22 में Magistrate domestic violence के acts से हुई injuries, जिसमें:

mental torture

और

emotional distress

भी शामिल हैं, के लिए compensation और damages का order कर सकता है। [DV Act, 2005, s.22]

इसलिए:

Section 18 → Protection

Section 20 → Monetary Relief

Section 22 → Compensation and Damages

तीनों अलग statutory remedies हैं।

Section 18 और Section 31 — Breach का परिणाम

Section 18 का protection order केवल advisory direction नहीं है।

Section 31 के अनुसार respondent द्वारा protection order या interim protection order का breach एक offence है और इसके लिए:

एक वर्ष तक imprisonment, या

₹20,000 तक fine, या

दोनों

का प्रावधान है।

Rules का Rule 15 breach की reporting और enforcement procedure देता है।

Rule 15 — Protection Order के Breach की Reporting

Rule 15 के अनुसार aggrieved person protection order या interim protection order के breach की report:

Protection Officer को

कर सकती है। [DV Rules, 2006, Rule 15]

Report लिखित और signed होनी चाहिए।

Protection Officer उस complaint की copy और जिस protection order का breach alleged है उसकी copy concerned Magistrate को forward करेगा।

Aggrieved person चाहे तो breach की complaint सीधे Magistrate या Police को भी कर सकती है।

Breach के बाद Protection Officer की Duty

यदि protection order breach होने के बाद aggrieved person Protection Officer की assistance मांगती है, तो Protection Officer को local Police Station की सहायता लेकर उसे immediately rescue करने और appropriate cases में Police authorities के समक्ष report lodge कराने में सहायता करनी होती है। [DV Rules, 2006, Rule 15(5)]

यह Section 18 के protective order को वास्तविक enforcement mechanism प्रदान करता है।

Respondent की Resistance भी Breach

Rule 15(7) के अनुसार Court के orders के enforcement में respondent या उसके behalf पर purportedly acting किसी अन्य व्यक्ति द्वारा किया गया resistance, protection order या interim protection order का breach माना जाएगा। [DV Rules, 2006, Rule 15(7)]

इसका उद्देश्य Court order के implementation को obstruct करने से रोकना है।

Section 18 का Enforcement पूरे भारत में

Section 27(2) के अनुसार Act के तहत बनाया गया कोई भी order पूरे भारत में enforceable है। [DV Act, 2005, s.27(2)]

इसलिए Protection Order केवल उस district तक सीमित नहीं रहता जहाँ Magistrate ने order pass किया है।

Protection Order की अवधि

Section 25(1) के अनुसार Section 18 के तहत बनाया गया Protection Order तब तक in force रहेगा जब तक aggrieved person discharge के लिए application नहीं करती। [DV Act, 2005, s.25(1)]

यह Section 18 की अत्यंत महत्वपूर्ण विशेषता है।

Protection Order की अवधि केवल कुछ fixed days या months तक स्वतः सीमित नहीं है।

Protection Order में Modification

Section 25(2) के अनुसार यदि aggrieved person या respondent application देता है और Magistrate को circumstances में ऐसा change दिखाई देता है जिसके कारण order में:

alteration

modification

या

revocation

आवश्यक है, तो Magistrate reasons in writing record करके appropriate order pass कर सकता है। [DV Act, 2005, s.25(2)]

इसलिए Section 18 का order circumstances बदलने पर judicially modified हो सकता है।

Section 18 और Police Assistance

Section 18 का order प्रभावी ढंग से लागू करने के लिए Police assistance महत्वपूर्ण है।

Rules के अनुसार Protection Officer enforcement में Police की assistance ले सकता है।

Form IV में भी aggrieved person को यह information दी जाती है कि उसे Protection Officer या Police की assistance से danger की स्थिति से rescue किया जा सकता है।

Section 18 और Stridhan की Recovery

Section 18(e) assets और stridhan को alienation/operation से protect करता है।

इसके अतिरिक्त Section 19(8) Magistrate को respondent को aggrieved person का stridhan या अन्य property/valuable security वापस करने का direction देने की express power देता है। [DV Act, 2005, ss.18(e), 19(8)]

इसलिए यदि मुख्य उद्देश्य property की actual restoration है, तो Section 19(8) भी relevant statutory provision है।

Supreme Court का महत्वपूर्ण दृष्टिकोण

Shyamlal Devda v. Parimala, 2020, Supreme Court

Shyamlal Devda & Ors. v. Parimala, 2020, Supreme Court में Supreme Court ने Section 12 के साथ Sections 18, 19 और 20 के reliefs पर विचार किया।

Court ने यह भी स्पष्ट किया कि यदि husband के relatives के विरुद्ध domestic violence के specific allegations नहीं हैं, तो केवल generalized allegations के आधार पर उनके विरुद्ध DV proceedings जारी रखना उचित नहीं है। [Shyamlal Devda v. Parimala, 2020, Supreme Court]

Section 18 के context में इसका महत्व यह है कि protection order जिस respondent के विरुद्ध मांगा जा रहा है, उसके conduct के संबंध में specific factual foundation होना आवश्यक है।

Prabha Tyagi v. Kamlesh Devi, 2022, Supreme Court

Prabha Tyagi v. Kamlesh Devi, 2022, Supreme Court में Supreme Court ने DV Act की beneficial और remedial character तथा Section 12 proceedings के व्यापक framework पर विचार किया। इस judgment में Court ने स्पष्ट किया कि Domestic Incident Report का अभाव अपने-आप में Magistrate की jurisdiction समाप्त नहीं करता।

यह Section 18 के लिए भी महत्वपूर्ण है क्योंकि protection order की मांग Section 12 proceeding के माध्यम से की जा सकती है और relief केवल इस procedural ground पर नकारा नहीं जा सकता कि पहले DIR तैयार नहीं हुई थी।

Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court

Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court का मुख्य विषय Section 17 और “shared household” की interpretation था, लेकिन इसका Section 18 से practical connection है क्योंकि residence-related protection और shared household rights को Sections 17–19 के संयुक्त framework में समझना पड़ता है।

इस judgment ने shared household की restrictive interpretation को reject किया और statutory definition को व्यापक रूप से समझा।

Protection Order का Practical Structure

किसी case में Court परिस्थितियों के अनुसार Section 18 के अंतर्गत respondent को:

domestic violence करने से रोक सकता है

domestic violence में सहायता या abetment से रोक सकता है

workplace/school में प्रवेश से रोक सकता है

किसी भी prohibited communication से रोक सकता है

assets, lockers, bank accounts या stridhan को alienate/deal करने से रोक सकता है

dependants, relatives या assistance देने वाले persons के विरुद्ध violence से रोक सकता है

और

अन्य case-specific protective acts से रोक सकता है।

यह statutory mechanism Sections 12, 18, 23, 25 और 31 तथा Rules 8 और 15 को साथ पढ़ने पर स्पष्ट होता है।

निष्कर्ष

Section 18 DV Act की मुख्य protective remedy है। Magistrate, aggrieved person और respondent को सुनने के बाद तथा prima facie domestic violence होने या likely होने से satisfied होकर respondent के विरुद्ध Protection Order पारित कर सकता है। [DV Act, 2005, s.18]

Protection Order का scope केवल मारपीट रोकने तक सीमित नहीं है। यह physical, sexual, verbal/emotional और economic abuse, workplace/school access, communication, stridhan और assets, तथा dependants और assistance देने वाले relatives/persons की protection तक जा सकता है। [DV Act, 2005, ss.3, 18]

Section 18 को Sections 17, 19, 20, 22, 23, 25 और 31 तथा Rules 8 और 15 के साथ पढ़ना आवश्यक है। विशेष रूप से, Protection Order के breach पर Section 31 criminal consequence देता है और Rule 15 breach की reporting तथा rescue/enforcement mechanism प्रदान करता है।
