घरेलू हिंसा अधिनियम, 2005 की धारा 17 — Shared Household में निवास का अधिकार
Protection of Women from Domestic Violence Act, 2005 की धारा 17 घरेलू संबंध में रहने वाली प्रत्येक महिला को shared household में निवास का वैधानिक अधिकार देती है, चाहे उस महिला का उस घर में कोई ownership, title या beneficial interest हो या न हो। साथ ही respondent को महिला को shared household से केवल अपनी इच्छा से निकालने या exclude करने से रोका गया है। [DV Act, 2005, s.17]
धारा 17(1) — Shared Household में रहने का अधिकार
Section 17(1) का सबसे महत्वपूर्ण प्रावधान है कि हर woman in a domestic relationship को shared household में reside करने का right होगा।
यह अधिकार:
ownership
title
या
beneficial interest
पर निर्भर नहीं है। [DV Act, 2005, s.17(1)]
अर्थात केवल यह तथ्य कि घर महिला के नाम पर नहीं है, अपने-आप में उसके residence right को समाप्त नहीं करता।
Section 17(1) में Legislature ने स्पष्ट रूप से कहा है:
“whether or not she has any right, title or beneficial interest in the same.” [DV Act, 2005, s.17(1)]
यह Section 17 की मूल protective principle है।
“Shared Household” का अर्थ
Section 2(s) के अनुसार shared household वह household है जहाँ aggrieved person:
वर्तमान में रहती है, या
किसी stage पर domestic relationship में रह चुकी है,
चाहे वह अकेले रहती हो या respondent के साथ। [DV Act, 2005, s.2(s)]
इस definition में ऐसा household भी शामिल हो सकता है जो:
jointly owned या tenanted हो, या
aggrieved person के नाम पर हो, या
respondent के नाम पर हो, या
दोनों के नाम पर हो, या
respondent के joint family का household हो।

इसलिए Section 17 को समझने के लिए सबसे पहले यह determine करना आवश्यक है कि संबंधित property statutory sense में “shared household” है या नहीं।
Section 17(2) — जबरन बेदखली पर रोक
Section 17(2) कहता है कि aggrieved person को respondent द्वारा shared household या उसके किसी part से:
evict
या
exclude
नहीं किया जा सकता।
लेकिन एक महत्वपूर्ण qualification है:
यह prohibition “save in accordance with the procedure established by law” के अधीन है। [DV Act, 2005, s.17(2)]
इसका अर्थ है कि respondent अपने स्तर पर महिला को घर से बाहर नहीं निकाल सकता। यदि lawful eviction या possession से संबंधित कोई अधिकार है, तो उसे कानून द्वारा निर्धारित procedure के अनुसार ही लागू किया जा सकता है।
Section 17 और Section 19 का संबंध
Section 17 right to reside प्रदान करता है।
Section 19 Magistrate को इस residence right को practically protect करने के लिए Residence Orders pass करने की power देता है। [DV Act, 2005, ss.17, 19]
Section 19 के तहत Magistrate circumstances के अनुसार respondent को:
aggrieved person को shared household से dispossess करने से रोक सकता है
shared household के उस portion में प्रवेश करने से रोक सकता है जहाँ aggrieved person रहती है
shared household को alienate/dispose/encumber करने से रोक सकता है
अपने rights renounce करने से रोक सकता है
या
respondent को shared household से remove होने का direction दे सकता है, जहाँ statutory requirements पूरी होती हैं।

इसलिए Section 17 और Section 19 में distinction अत्यंत महत्वपूर्ण है:
Section 17 → substantive right to reside
Section 19 → उस right को enforce/protect करने के लिए judicial residence orders
क्या Section 17 महिला को Property Ownership देता है?
नहीं।
Section 17 residence का statutory right देता है; यह अपने-आप:
ownership
title
या
proprietary interest
create नहीं करता।
Section 17(1) स्वयं इस बात को recognise करता है कि woman का ownership या beneficial interest हो भी सकता है और नहीं भी। [DV Act, 2005, s.17(1)]
इसलिए right to reside और right of ownership अलग legal concepts हैं।
Supreme Court — Satish Chander Ahuja Case
Shared household की interpretation पर Supreme Court का सबसे महत्वपूर्ण leading judgment है:
Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court.
Supreme Court ने Section 2(s) की interpretation करते हुए S.R. Batra v. Taruna Batra में अपनाई गई उस restrictive interpretation को overrule किया जिसमें shared household को केवल उस property तक सीमित कर दिया गया था जिसमें husband का legal/equitable interest हो। [Satish Chander Ahuja, 2020, Supreme Court]
Supreme Court ने स्पष्ट किया कि Section 2(s) और Section 17 को साथ पढ़ते हुए shared household की statutory definition को केवल husband की ownership तक सीमित नहीं किया जा सकता।
इस judgment में Court ने यह भी emphasise किया कि shared household का determination domestic relationship और parties द्वारा उस household में residence के statutory requirements के आधार पर किया जाना चाहिए।
[Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court]
यह Section 17 को समझने वाला सबसे महत्वपूर्ण Supreme Court authority है।
S.R. Batra v. Taruna Batra की वर्तमान स्थिति
S.R. Batra v. Taruna Batra, 2007, Supreme Court में Supreme Court ने shared household की interpretation comparatively narrow manner में की थी।
लेकिन बाद में Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court ने उस interpretation को overrule कर दिया।
इसलिए वर्तमान legal position में Section 17 के संदर्भ में Satish Chander Ahuja को leading authority माना जाना चाहिए।
Section 17 और Shared Household में Actual Residence
Section 2(s) में shared household की definition “lives or at any stage has lived” language का प्रयोग करती है। [DV Act, 2005, s.2(s)]
इसका महत्व यह है कि household के साथ domestic relationship और residence का statutory connection होना आवश्यक है।
केवल यह तथ्य कि कोई property respondent के नाम पर है, पर्याप्त नहीं है कि वह automatically shared household बन जाए।
इसी प्रकार केवल property में ownership न होना भी महिला के residence right को automatically समाप्त नहीं करता।
Property status और statutory shared-household status अलग प्रश्न हैं।
Section 17 और Joint Family Property
Section 2(s) expressly कहता है कि shared household में ऐसा household भी शामिल हो सकता है जो joint family का हो जिसमें respondent member है, irrespective of whether respondent या aggrieved person का उस household में कोई right, title या interest है। [DV Act, 2005, s.2(s)]
इसका मतलब यह है कि joint family property के मामलों में केवल यह कहना कि property respondent के व्यक्तिगत नाम पर नहीं है, Section 17 के residence claim को अपने-आप समाप्त नहीं करता।
लेकिन अंततः Court को statutory definition के अनुसार facts examine करने होंगे।
Section 17 और Tenanted House
Section 2(s) में shared household में tenanted household भी expressly शामिल है। [DV Act, 2005, s.2(s)]
इसलिए shared household का concept केवल owned property तक सीमित नहीं है।
यदि statutory requirements पूरी होती हैं, तो rented/tenanted premises भी shared household हो सकता है।
Section 17 और Respondent का Right
Section 17(2) respondent के lawful property rights को पूरी तरह समाप्त नहीं करता।
Provision यह कहता है कि aggrieved person को respondent द्वारा shared household से evict या exclude नहीं किया जा सकता except in accordance with procedure established by law। [DV Act, 2005, s.17(2)]
इसलिए Section 17 का उद्देश्य respondent की property rights को automatically extinguish करना नहीं, बल्कि aggrieved woman के residence को unlawful dispossession से protect करना है।
Section 17 और Residence Order
यदि respondent महिला को shared household से बाहर करने का प्रयास करता है, तो aggrieved person Section 19 के तहत appropriate Residence Order मांग सकती है।
Section 19(1) में Magistrate को विभिन्न protective directions देने की power है।
इसलिए Section 17 का right practical relief में बदलने के लिए Section 19 अत्यंत महत्वपूर्ण है।
Section 17 और Protection Order
Section 18 के तहत Magistrate respondent को domestic violence करने या करवाने से prohibit करने वाला Protection Order pass कर सकता है।
इसके अलावा respondent को aggrieved person से communication करने, उसके workplace/school में प्रवेश करने, assets alienate करने आदि से भी restrain किया जा सकता है। [DV Act, 2005, s.18]
Residence-related dispute में Section 17 और Section 19 primary provisions हैं, जबकि facts के अनुसार Section 18 का protection order भी relevant हो सकता है।
Section 17 और Rules
Protection of Women from Domestic Violence Rules, 2006 में Section 17 के लिए अलग standalone “Rule 17” नहीं है।
यह distinction महत्वपूर्ण है क्योंकि Rules में Rule 17 medical assistance से संबंधित है, Section 17 residence right से नहीं।
Section 17 का practical implementation मुख्यतः:
Section 19 — Residence Orders
Rule 8 — Protection Officer की assistance
और
Form II / prescribed application mechanism
के माध्यम से होता है।
Form II में aggrieved person Section 19 के residence order के अंतर्गत shared household से dispossession रोकने, उस portion में respondent का प्रवेश रोकने, alienation रोकने, personal effects तक continued access और alternate accommodation/rent जैसी reliefs मांग सकती है।
Protection Officer की भूमिका
Section 9 के अंतर्गत Protection Officer को Magistrate की assistance करने और aggrieved person को statutory relief प्राप्त करने में सहायता करने का duty है। [DV Act, 2005, s.9]
Rules के Rule 10 के अनुसार Magistrate के written direction पर Protection Officer:
shared household का home visit कर सकता है
preliminary enquiry कर सकता है
aggrieved person के personal effects restore कराने में सहायता कर सकता है
और
children की custody regain करने में सहायता कर सकता है। [DV Rules, 2006, Rule 10]
इससे Section 17 के residence right को practical protection देने में Protection Officer की भूमिका स्पष्ट होती है।
Section 17 और Safety Plan
Rules का Form V Safety Plan प्रदान करता है।
इसमें physical violence, sexual violence, strangulation, children के प्रति violence और अन्य संभावित risks के साथ safety measures तथा Court से मांगे जाने वाले orders का विवरण दर्ज किया जा सकता है।
यदि shared household में रहने से aggrieved person या उसके बच्चों को continuing risk है, तो safety considerations के आधार पर appropriate protection/residence reliefs Court के समक्ष रखे जा सकते हैं।
क्या Section 17 के तहत तुरंत घर में प्रवेश मिल जाता है?
Section 17 substantive right to reside प्रदान करता है, लेकिन particular factual situation में उस right को enforce करने के लिए Magistrate से appropriate order, विशेषतः Section 19 के तहत residence order, आवश्यक हो सकता है।
Section 17 स्वयं हर factual situation में physical possession restoration की detailed procedure नहीं देता।
ऐसे मामलों में Court को Section 17 और Section 19 के साथ facts, existing possession, domestic relationship और applicable law को देखना होता है।
Section 17 का Section 36 से संबंध
Section 36 कहता है कि DV Act के provisions other laws के addition में हैं, not in derogation thereof। [DV Act, 2005, s.36]
इसलिए Section 17 को अन्य applicable property, family और civil laws से completely isolated provision के रूप में नहीं पढ़ा जाना चाहिए।
जहाँ property ownership, partition, eviction या title का स्वतंत्र विवाद हो, वहाँ संबंधित अन्य कानून भी लागू हो सकते हैं; लेकिन DV Act के तहत aggrieved person का statutory residence protection अपने क्षेत्र में operate करता है।
Supreme Court का प्रमुख सिद्धांत
Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court Section 17 के लिए सबसे महत्वपूर्ण leading authority है।
इस निर्णय के अनुसार shared household की definition को संकीर्ण रूप से केवल उस property तक सीमित नहीं किया जा सकता जिसमें husband का ownership या legal/equitable interest हो। Section 2(s) की definition और Section 17 के residence right को statutory text के अनुसार व्यापक रूप से समझना होगा।
इस judgment ने S.R. Batra v. Taruna Batra, 2007, Supreme Court की restrictive interpretation को overrule किया।
इसलिए वर्तमान legal position में Section 17 पढ़ते समय Satish Chander Ahuja को प्राथमिक Supreme Court authority माना जाना चाहिए।

यह Section 17 को Sections 2(s), 18 और 19 के साथ पढ़ने पर बनने वाली statutory scheme है।
निष्कर्ष
Section 17 DV Act में महिला के residence right का मूल statutory safeguard है। Domestic relationship में रहने वाली प्रत्येक महिला को shared household में निवास का अधिकार है, भले ही उसके नाम उस property में कोई ownership, title या beneficial interest न हो। [DV Act, 2005, s.17(1)]
Respondent महिला को shared household या उसके किसी हिस्से से मनमाने ढंग से evict या exclude नहीं कर सकता; ऐसा केवल lawfully established procedure के अनुसार किया जा सकता है। [DV Act, 2005, s.17(2)]
Section 17 का सबसे महत्वपूर्ण Supreme Court authority — Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court — shared household की interpretation को व्यापक statutory framework में रखता है और S.R. Batra v. Taruna Batra की restrictive approach को overrule करता है।
इसलिए Section 17 का मूल सूत्र है:
“Ownership नहीं, बल्कि statutory ‘shared household’ और domestic relationship Section 17 के residence right के निर्धारण में केंद्रीय हैं।”
