Section 7 of the Bharatiya Nyaya Sanhita empowers courts to award rigorous, simple, or partly rigorous and partly simple imprisonment where the offence permits imprisonment of either description, subject to judicial discretion and constitutional safeguards.
Under Section 6 of the Bharatiya Nyaya Sanhita, life imprisonment is reckoned as 20 years only for calculating fractions of punishment. It does not reduce a life sentence automatically and remains subject to judicial directions and statutory exceptions.
Section 5 of the Bharatiya Nyaya Sanhita allows the appropriate Government to commute any punishment without the offender’s consent, subject to Section 474 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and constitutional safeguards.
