Section 25 — Orders की अवधि, Alteration, Modification और Revocation DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 25 — Orders की अवधि, Alteration, Modification और Revocation

धारा 25 Domestic Violence Act के अंतर्गत पारित orders की अवधि और बाद में परिस्थितियों के बदलने पर उनके alteration, modification या revocation की व्यवस्था करती है। यह धारा विशेष रूप से Section 18 के Protection Order की अवधि तथा किसी भी order को बदलने या समाप्त करने की judicial power से संबंधित है। [DV Act, 2005, s.25]

धारा 25(1) — Protection Order की अवधि

Section 25(1) में कहा गया है कि Section 18 के तहत बनाया गया Protection Order तब तक प्रभावी रहेगा जब तक aggrieved person discharge के लिए application नहीं करती। [DV Act, 2005, s.25(1)]

यह एक महत्वपूर्ण विशेषता है क्योंकि Act Section 18 Protection Order के लिए कोई निश्चित अवधि जैसे 30 दिन, 6 महीने या 1 वर्ष निर्धारित नहीं करता।

अर्थात Protection Order केवल निश्चित समय बीत जाने से स्वतः समाप्त नहीं होता।

Section 25(1) का Practical Effect

यदि Magistrate ने Section 18 के तहत respondent को:

domestic violence करने से रोका है,

aggrieved person से contact करने से रोका है,

उसके workplace में प्रवेश करने से रोका है,

या

किसी अन्य specified act से prohibited किया है,

तो वह Protection Order Section 25(1) के अनुसार तब तक force में रहता है जब तक aggrieved person उसके discharge के लिए application नहीं करती। [DV Act, 2005, ss.18, 25(1)]

क्या Protection Order की कोई Fixed Expiry Date होती है?

Section 25(1) के अनुसार नहीं।

Protection Order की statutory duration को किसी fixed calendar period से नहीं जोड़ा गया है।

इसका operative period Section 25(1) में prescribed है—जब तक aggrieved person discharge के लिए apply नहीं करती। [DV Act, 2005, s.25(1)]

इसलिए केवल यह कहना कि “Protection Order छह महीने के बाद समाप्त हो गया” Section 25(1) के statutory text के अनुरूप नहीं होगा, जब तक Court ने order को किसी अन्य वैध आधार पर modify/revoke/discharge न किया हो।

Section 25(2) — परिस्थितियों में परिवर्तन

Section 25(2) Act के सभी orders के संबंध में अधिक व्यापक provision है।

यदि:

aggrieved person, या

respondent

Magistrate के सामने application करता है और Magistrate satisfied होता है कि circumstances में change हुआ है जिसके कारण किसी order में alteration, modification या revocation आवश्यक है, तो Magistrate appropriate order पारित कर सकता है। [DV Act, 2005, s.25(2)]

यह Section 25(2) की मूल statutory test है।

Alteration का अर्थ

Alteration का अर्थ existing order में आवश्यक परिवर्तन करना है।

उदाहरण के लिए, यदि Protection Order में respondent के communication पर कुछ restrictions निर्धारित हैं और बाद में परिस्थितियों में ऐसा परिवर्तन होता है कि order के किसी हिस्से में adjustment आवश्यक है, तो Magistrate Section 25(2) के तहत alteration पर विचार कर सकता है।

यह existing order को पूरी तरह समाप्त नहीं करता; order में आवश्यक परिवर्तन किया जा सकता है। [DV Act, 2005, s.25(2)]

Modification का अर्थ

Modification का अर्थ order की terms या conditions में judicial परिवर्तन करना है।

Section 25(2) में Magistrate को order को modify करने की express power दी गई है। [DV Act, 2005, s.25(2)]

इसका उपयोग तब किया जा सकता है जब original order की किसी condition को बदलने की आवश्यकता circumstances के change के कारण उत्पन्न हो।

Revocation का अर्थ

Revocation का अर्थ existing order को वापस लेना या समाप्त करना है।

Section 25(2) Magistrate को किसी order को revoke करने की भी express power देता है, यदि circumstances में change के कारण revocation आवश्यक हो। [DV Act, 2005, s.25(2)]

इसलिए Section 25(2) के अंतर्गत तीन अलग possibilities हैं:

Alteration → order में परिवर्तन

Modification → terms/conditions में बदलाव

Revocation → order को वापस लेना/समाप्त करना

Application कौन कर सकता है?

Section 25(2) के तहत application:

aggrieved person, या

respondent

द्वारा की जा सकती है। [DV Act, 2005, s.25(2)]

इसलिए यह remedy केवल aggrieved person के लिए नहीं है।

Respondent भी यदि circumstances में वास्तविक परिवर्तन हुआ है, तो appropriate application देकर order के alteration, modification या revocation की मांग कर सकता है।

“Change in Circumstances” आवश्यक है

Section 25(2) का सबसे महत्वपूर्ण शब्द है:

“change in the circumstances”.

केवल respondent या aggrieved person की असहमति पर्याप्त नहीं है।

Magistrate को पहले यह satisfaction होना चाहिए कि circumstances में ऐसा परिवर्तन हुआ है जिसके कारण order में alteration, modification या revocation आवश्यक है। [DV Act, 2005, s.25(2)]

इसलिए Section 25(2) existing order को routine तरीके से reopen करने का unrestricted mechanism नहीं है।

Reasons in Writing आवश्यक हैं

Section 25(2) में Magistrate को order alter, modify या revoke करते समय reasons in writing record करना आवश्यक है। [DV Act, 2005, s.25(2)]

यह requirement judicial transparency के लिए महत्वपूर्ण है।

इसका अर्थ है कि Magistrate को केवल यह लिखना पर्याप्त नहीं है कि “order modified” या “order revoked”।

Order में circumstances के change और उससे उत्पन्न necessity के आधार को judicially record किया जाना चाहिए।

Section 25(2) में Court की Power

यदि statutory conditions पूरी होती हैं, तो Magistrate:

alter

modify

या

revoke

कर सकता है और appropriate order pass कर सकता है। [DV Act, 2005, s.25(2)]

इसलिए Section 25(2) एक continuing judicial control mechanism है।

Domestic violence proceeding में circumstances स्थिर नहीं रहतीं। Safety, residence, relationship, financial circumstances, communication requirements और अन्य factual circumstances बदल सकते हैं। Section 25(2) ऐसे changes के अनुसार Court order को responsive बनाने की अनुमति देता है।

Section 25(1) और Section 25(2) में अंतर

Section 25(1) केवल Section 18 Protection Order की duration से संबंधित है। [DV Act, 2005, s.25(1)]

Section 25(2) Act के किसी भी order के alteration, modification या revocation से संबंधित है, यदि circumstances में change हो। [DV Act, 2005, s.25(2)]

इसलिए Section 25(1) और 25(2) को एक ही provision समझना उचित नहीं है।

Section 25(2) और Section 18 Protection Order

Section 18 के तहत Protection Order में respondent को domestic violence और specified conduct से prohibit किया जा सकता है। [DV Act, 2005, s.18]

यदि बाद में circumstances change होती हैं, तो Section 25(2) के तहत उस Protection Order के:

terms modify

conditions alter

या

order revoke

किए जाने पर Court विचार कर सकता है। [DV Act, 2005, s.25(2)]

Rule 12 — Protection Order में बदलाव का महत्व

Protection of Women from Domestic Violence Rules, 2006 में Rule 12 protection order की conditions और उनके enforcement से संबंधित है।

Rule 12 के अनुसार यदि Court ने respondent को shared household में प्रवेश करने, stay away रहने या petitioner से contact करने से restrain किया है, तो aggrieved person का बाद में respondent को invitation देना अपने-आप protection order की restraint को waive नहीं करता। [DV Rules, 2006, Rule 12(4)]

जब तक protection order Section 25(2) के अनुसार duly modified नहीं होता, restraint लागू रहती है।

यह Rule 12(4) Section 25(2) के practical importance को बहुत स्पष्ट करता है।

Rule 12(4) — Invitation से Protection Order समाप्त नहीं होता

यह एक अत्यंत महत्वपूर्ण practical point है।

मान लीजिए Court ने respondent को aggrieved woman से contact करने या shared household में प्रवेश करने से restrain किया है।

बाद में aggrieved woman स्वयं respondent को घर आने के लिए invite करती है।

केवल invitation देने से Court का Protection Order समाप्त या waive नहीं हो जाता।

Protection Order तभी legally modify होगा जब उसे Section 25(2) के अनुसार duly modified किया जाए। [DV Rules, 2006, Rule 12(4)]

इसलिए parties का private conduct Court order का substitute नहीं है।

Section 25 और Breach of Protection Order

Section 31 के अनुसार Section 18 के Protection Order या interim Protection Order का breach offence है। [DV Act, 2005, s.31]

Rules के Rule 15 के अनुसार aggrieved person breach की report Protection Officer को कर सकती है, या सीधे Magistrate अथवा Police को complaint कर सकती है। [DV Rules, 2006, Rule 15]

इसलिए यदि respondent यह दावा करता है कि Protection Order अब लागू नहीं है, तो केवल उसका unilateral belief पर्याप्त नहीं है।

जब तक order legally modified/revoked नहीं हुआ है, उसका पालन करना आवश्यक है।

Rule 15(7) — Enforcement में Resistance

Rule 15(7) के अनुसार Court के orders के enforcement में respondent या उसकी ओर से purportedly acting किसी अन्य व्यक्ति द्वारा किया गया resistance भी protection order या interim protection order का breach माना जाएगा। [DV Rules, 2006, Rule 15(7)]

इसका Section 25 से महत्वपूर्ण संबंध है: यदि order को बदलना है, तो Section 25(2) का judicial route अपनाना होगा; order के enforcement को स्वयं obstruct करना permissible नहीं है।

Section 25 और Interim Orders

Section 23 Magistrate को interim और ex parte orders की power देता है। [DV Act, 2005, s.23]

Section 25(2) में “any order made under this Act” कहा गया है। [DV Act, 2005, s.25(2)]

इसलिए circumstances में change होने पर Act के applicable orders के alteration/modification/revocation का प्रश्न Section 25(2) के framework में examine किया जा सकता है।

हालांकि किसी particular interim order की nature और duration को उसके enabling provision तथा order की exact terms के साथ पढ़ना आवश्यक है।

Section 25 और Section 24

Section 24 के अनुसार Act के तहत Magistrate द्वारा passed order की copy free of cost parties, concerned police officer और relevant service provider को दी जाती है। [DV Act, 2005, s.24]

इसका practical महत्व Section 25(2) में इसलिए है क्योंकि original order और बाद में modified/revoked order के terms का स्पष्ट record enforcement authorities के पास होना आवश्यक है।

Section 25 और Section 28

Section 28(1) के अनुसार Sections 12, 18, 19, 20, 21, 22 और 23 की proceedings तथा Section 31 offences सामान्यतः CrPC के provisions द्वारा governed होती हैं, subject to the DV Act. [DV Act, 2005, s.28]

Section 25 स्वयं Section 28(1) में expressly listed नहीं है।

इसलिए Section 25(2) की application पर Court को Act की specific statutory scheme और applicable procedural law के अनुसार आगे बढ़ना होता है।

Section 25 और Consent/Compromise

Section 25(2) का practical importance उस situation में भी है जहाँ parties के बीच बाद में settlement या reconciliation हो जाती है।

यदि Protection Order अभी भी formally in force है, तो parties का private understanding अपने-आप Court order को समाप्त नहीं करता।

Rules का Rule 12(4) स्पष्ट करता है कि aggrieved person का invitation भी restraint को waive नहीं करता, जब तक protection order Section 25(2) के अनुसार duly modified न हो। [DV Rules, 2006, Rule 12(4)]

इसलिए settlement/reconciliation की स्थिति में appropriate judicial order प्राप्त करना महत्वपूर्ण है।

Section 25 और Discharge

Section 25(1) में specifically कहा गया है कि Section 18 Protection Order तब तक force में रहेगा “till the aggrieved person applies for discharge.” [DV Act, 2005, s.25(1)]

यहाँ “discharge” का statutory reference मुख्यतः Protection Order की continuation के context में है।

दूसरी ओर Section 25(2) में alteration, modification और revocation की broader mechanism है, जिसमें application aggrieved person या respondent दोनों कर सकते हैं। [DV Act, 2005, s.25(2)]

Section 25 का Practical Example

मान लीजिए Magistrate ने Section 18 के तहत respondent को aggrieved woman से किसी भी प्रकार का communication करने से रोक दिया।

बाद में parties के circumstances में महत्वपूर्ण परिवर्तन होता है और respondent Section 25(2) के तहत order modification की application देता है।

Magistrate circumstances में change की वास्तविकता और modification की necessity से satisfied होने पर reasons in writing record करके appropriate modification order कर सकता है। [DV Act, 2005, ss.18, 25(2)]

जब तक ऐसा judicial modification नहीं होता, original Protection Order operative रहेगा।

दूसरा Practical Example — Residence-related Order

यदि Court ने Section 19 के तहत residence-related order पारित किया और बाद में circumstances materially change हो गए, तो Section 25(2) के तहत aggrieved person या respondent appropriate application कर सकता है।

यदि Magistrate circumstances के change से satisfied होता है, तो वह reasons in writing record करके order में alteration, modification या revocation कर सकता है। [DV Act, 2005, ss.19, 25(2)]

Section 25 की सबसे महत्वपूर्ण विशेषता

Section 25(2) का उद्देश्य यह सुनिश्चित करना है कि DV Act का order एक बार पारित होने के बाद factual circumstances से completely disconnected होकर rigid न बना रहे।

यदि circumstances बदलती हैं, तो Court के पास existing order को:

alter

modify

या

revoke

करने की statutory power है। [DV Act, 2005, s.25(2)]

लेकिन यह power reasons in writing और judicial satisfaction के अधीन है।

Section 25 की संपूर्ण संरचना

Section 25(1)
Section 18 का Protection Order तब तक force में रहेगा जब तक aggrieved person discharge के लिए apply नहीं करती। [DV Act, 2005, s.25(1)]

Section 25(2)
Aggrieved person या respondent change in circumstances के आधार पर application कर सकता है। [DV Act, 2005, s.25(2)]

Magistrate की satisfaction
Circumstances में change ऐसा होना चाहिए जिससे alteration, modification या revocation आवश्यक हो। [DV Act, 2005, s.25(2)]

Reasons in Writing
Magistrate को reasons record करने होते हैं। [DV Act, 2005, s.25(2)]

Rule 12(4)
Party का private invitation existing protection order को स्वतः waive नहीं करता।

Rule 15
Protection Order के breach के लिए reporting और enforcement mechanism उपलब्ध है।

निष्कर्ष

Section 25 DV Act के orders की continuity और subsequent judicial modification का महत्वपूर्ण provision है।

Section 25(1) के तहत Section 18 का Protection Order किसी fixed period के बाद स्वतः समाप्त नहीं होता; वह तब तक force में रहता है जब तक aggrieved person discharge के लिए apply नहीं करती। [DV Act, 2005, s.25(1)]

Section 25(2) के तहत aggrieved person या respondent, circumstances में change होने पर, किसी Act-order के alteration, modification या revocation के लिए Magistrate के समक्ष application कर सकते हैं। Magistrate को appropriate order pass करने से पहले change in circumstances से satisfied होना और reasons in writing record करना आवश्यक है। [DV Act, 2005, s.25(2)]

विशेष रूप से Rule 12(4) यह स्पष्ट करता है कि यदि Protection Order के तहत respondent को contact या shared household में प्रवेश से restrain किया गया है, तो aggrieved person द्वारा बाद में invitation देने मात्र से वह restraint समाप्त नहीं होती; Section 25(2) के अनुसार formal modification आवश्यक है।
