Section 24 — आदेश की प्रतियाँ निःशुल्क उपलब्ध कराने का अधिकार DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 24 — आदेश की प्रतियाँ निःशुल्क उपलब्ध कराने का अधिकार

धारा 24 का उद्देश्य यह सुनिश्चित करना है कि DV Act के अंतर्गत Magistrate द्वारा पारित किसी भी order की प्रतिलिपि संबंधित पक्षों और enforcement में आवश्यक संस्थाओं को बिना किसी शुल्क के उपलब्ध हो। यह provision Court के आदेश को प्रभावी रूप से लागू कराने और संबंधित authorities को उसकी जानकारी सुनिश्चित करने के लिए महत्वपूर्ण है। [DV Act, 2005, s.24]

धारा 24 का मूल प्रावधान

Section 24 के अनुसार, जब Magistrate इस Act के तहत कोई भी order पारित करता है, तो Magistrate को आदेश देना होगा कि उस order की copy free of cost उपलब्ध कराई जाए। [DV Act, 2005, s.24]

यहाँ Legislature ने “shall” शब्द का प्रयोग किया है।

इसलिए Section 24 Magistrate पर एक mandatory statutory duty डालती है।

यह केवल Protection Order तक सीमित नहीं है। Section 24 की language “any order under this Act” है। [DV Act, 2005, s.24]

अर्थात Act के अंतर्गत पारित विभिन्न प्रकार के orders इस provision के दायरे में आ सकते हैं।

किन व्यक्तियों और संस्थाओं को Copy दी जाएगी

Section 24 के तहत order की copy free of cost निम्न को दी जानी है।

Application के parties

सबसे पहले order की copy parties to the application को दी जाएगी। [DV Act, 2005, s.24]

इसका उद्देश्य यह है कि aggrieved person और respondent दोनों को Court द्वारा पारित order की स्पष्ट जानकारी उपलब्ध हो।

यह विशेष रूप से Protection Order, Residence Order, Monetary Relief, Custody Order, Compensation Order या Interim Order के enforcement के लिए महत्वपूर्ण है।

संबंधित Police Station के In-charge को Copy

Order की एक copy उस Police Station के officer-in-charge को भी दी जानी है, जिसके jurisdiction में Magistrate से approach किया गया है। [DV Act, 2005, s.24]

यह requirement इसलिए महत्वपूर्ण है क्योंकि DV Act के कई orders के implementation में Police assistance की आवश्यकता हो सकती है।

उदाहरण के लिए Section 18 के Protection Order और Section 19 के Residence Order के implementation में Police assistance की statutory व्यवस्था है। [DV Act, 2005, ss.18, 19]

Service Provider को Copy

Section 24 में यह भी कहा गया है कि Court की local jurisdiction के भीतर located any service provider को order की copy दी जाएगी। [DV Act, 2005, s.24]

लेकिन यहाँ एक विशेष स्थिति है।

यदि किसी service provider ने Domestic Incident Report register की है, तो उस particular service provider को भी order की copy दी जानी है। [DV Act, 2005, s.24]

इससे service provider को उस proceeding में पारित order की जानकारी प्राप्त होती है और वह अपने statutory functions के अनुसार assistance प्रदान कर सकता है।

“Free of Cost” का महत्व

Section 24 का सबसे महत्वपूर्ण शब्द है:

“free of cost”

इसका अर्थ है कि जिन व्यक्तियों और authorities को Section 24 के अनुसार order की copy दी जानी है, उनसे उस statutory copy के लिए Court fee या copying charge नहीं लिया जाना चाहिए। [DV Act, 2005, s.24]

यह DV Act की protective character के अनुरूप है।

किन Orders पर Section 24 लागू हो सकता है

Section 24 किसी एक particular type के order तक सीमित नहीं है।

इसकी language “any order passed under this Act” है। [DV Act, 2005, s.24]

इसमें facts और proceeding के अनुसार:

Protection Order — Section 18

Residence Order — Section 19

Monetary Relief — Section 20

Custody Order — Section 21

Compensation Order — Section 22

Interim/Ex parte Order — Section 23

तथा Act के अन्य provisions के अंतर्गत पारित applicable orders शामिल हो सकते हैं। [DV Act, 2005, ss.18–24]

Section 23 के Interim और Ex Parte Orders

Section 23 Magistrate को interim और ex parte orders देने की शक्ति देता है।

Section 23(1) के तहत Magistrate proceedings में ऐसा interim order दे सकता है जिसे वह just and proper समझता है।

Section 23(2) के तहत prima facie domestic violence या उसकी likelihood होने पर prescribed affidavit के आधार पर Section 18, 19, 20, 21 या 22 के तहत ex parte order भी दिया जा सकता है। [DV Act, 2005, s.23]

यदि ऐसा order पारित किया जाता है, तो Section 24 की “any order under this Act” वाली language के कारण उसकी copy free of cost देने का statutory requirement लागू होता है। [DV Act, 2005, s.24]

Section 24 और Section 13 में अंतर

Section 13 notice की service से संबंधित है।

Section 13(1) के अनुसार Section 12 की hearing की date का notice Magistrate Protection Officer को देता है और Protection Officer उसे respondent तथा Magistrate द्वारा directed अन्य व्यक्ति पर prescribed manner में serve कराता है। [DV Act, 2005, s.13]

इसके विपरीत:

Section 13 → proceeding शुरू होने पर notice की service

Section 24 → order पारित होने के बाद order की copy

दोनों provisions को अलग-अलग समझना चाहिए।

Rule 12 — Means of Service of Notices

Protection of Women from Domestic Violence Rules, 2006 में Rule 12 notices की service से संबंधित है। Rules में यह भी prescribed है कि appearance के लिए notice में आवश्यक particulars होने चाहिए और service prescribed procedure के अनुसार की जानी है।

लेकिन Section 24 स्वयं order की free copy से संबंधित है।

इसलिए Rule 12 को Section 24 की copying requirement का substitute नहीं माना जा सकता।

Section 24 और Protection Officer

Protection Officer DV Act की implementation व्यवस्था में महत्वपूर्ण भूमिका निभाता है।

Section 9 के तहत Protection Officer का एक मुख्य duty Magistrate की सहायता करना है और Act के विभिन्न orders की implementation में सहायता करना भी उसके functions का हिस्सा है। [DV Act, 2005, s.9]

Rules के अनुसार Protection Officer Court के orders के enforcement में सहायता करता है, जिसमें Section 21 और अन्य specified orders भी शामिल हैं। [DV Rules, 2006, Rule 10]

इसलिए Court order की copy का उपलब्ध होना Protection Officer के practical implementation function के लिए आवश्यक है।

Section 24 और Service Provider

Section 10 registered service providers को DV Act के framework में statutory role देता है।

Service Provider domestic incident report record कर सकता है, medical examination में सहायता कर सकता है और aggrieved person को shelter उपलब्ध कराने में सहायता कर सकता है। [DV Act, 2005, s.10]

यदि service provider ने Domestic Incident Report register की है, तो Section 24 specifically उसे Court order की copy देने का प्रावधान करता है। [DV Act, 2005, s.24]

Section 24 और Domestic Incident Report

Domestic Incident Report का prescribed format Form I है।

Rules के Rule 5 के अनुसार Protection Officer complaint प्राप्त होने पर Form I में Domestic Incident Report तैयार करता है और उसे Magistrate को submit करता है तथा concerned police officer और service providers को copies forward करता है।

यदि aggrieved person के request पर service provider Domestic Incident Report record करता है, तो वह भी उसकी copy Magistrate और concerned Protection Officer को forward करता है।

Section 24 में इसी कारण “if any service provider has registered a domestic incident report” को विशेष रूप से शामिल किया गया है।

Section 24 और Enforcement

Section 24 स्वयं कोई अलग penalty provision नहीं बनाती।

इसका principal function है:

Order की official communication

Relevant parties को knowledge

Police को information

और

Service Provider को information

सुनिश्चित करना।

इसके बाद संबंधित order की प्रकृति के अनुसार enforcement provisions लागू होते हैं।

उदाहरण के लिए Protection Order का breach Section 31 के तहत punishable offence है।

Section 18 के Protection Order के संदर्भ में महत्व

Section 18 के तहत Magistrate respondent को domestic violence करने, abetment करने, workplace में प्रवेश करने, communication करने, assets/stridhan से संबंधित specified acts करने और अन्य specified acts से रोक सकता है। [DV Act, 2005, s.18]

ऐसे order की copy respondent और concerned Police Station को प्राप्त होना practical enforcement के लिए अत्यंत महत्वपूर्ण है।

Protection Order के breach की reporting के लिए Rules का Rule 15 भी relevant है। Aggrieved person Protection Officer को breach report कर सकती है और वह complaint तथा protection order की copy Magistrate को forward करता है। [DV Rules, 2006, Rule 15]

Section 24 और Section 31 का संबंध

Section 31 के अनुसार Protection Order या Interim Protection Order का breach respondent द्वारा किया जाना offence है।

इसलिए Section 24 के तहत order की copy संबंधित parties और Police को उपलब्ध कराने का practical महत्व बहुत अधिक है।

Order की communication और availability enforcement process को facilitate करती है।

Rules का Rule 15 breach की reporting और enforcement procedure को further regulate करता है।

क्या Section 24 केवल Aggrieved Person के लाभ के लिए है?

नहीं।

Section 24 में beneficiaries केवल aggrieved person नहीं हैं।

Statutory recipients में:

application के parties

concerned Police Station का officer-in-charge

local jurisdiction में स्थित service provider

और, विशेष रूप से,

वह service provider जिसने Domestic Incident Report register की हो

शामिल हैं। [DV Act, 2005, s.24]

इसलिए Section 24 का उद्देश्य broader institutional communication and enforcement है।

Section 24 और Section 25

Section 25 protection order की duration और alteration/modification/revocation से संबंधित है।

Section 25(1) के अनुसार Section 18 का Protection Order तब तक in force रहता है जब तक aggrieved person discharge के लिए application नहीं करती।

Section 25(2) के अनुसार circumstances में change होने पर Magistrate reasons in writing record करके order को alter, modify या revoke कर सकता है। [DV Act, 2005, s.25]

यदि बाद में Section 25 के तहत कोई नया order या modified order पारित होता है, तो Section 24 की “any order under this Act” वाली language के अनुसार उस order की copy भी statutory recipients को free of cost देने के framework में आती है।

Section 24 और Section 27

Section 27 के अनुसार competent Court Judicial Magistrate First Class या Metropolitan Magistrate हो सकता है, जहाँ:

aggrieved person permanently या temporarily रहती है, business करती है या employed है;

respondent रहता, business करता या employed है;

या cause of action arise हुआ है।

Section 27(2) के अनुसार Act के तहत बनाया गया order पूरे भारत में enforceable है। [DV Act, 2005, s.27]

इसलिए Section 24 के तहत order की copy उपलब्ध कराना और Section 27 के तहत उसका nationwide enforceability—दोनों provisions practical enforcement में महत्वपूर्ण हैं।

Rules, 2006 में Section 24 के लिए अलग Rule?

Protection of Women from Domestic Violence Rules, 2006 में Section 24 के नाम से कोई अलग standalone rule नहीं है।

यह निष्कर्ष उपलब्ध Rules text से निकलता है। Rules में notice service के लिए Rule 12, counselling के लिए Rule 14, protection order breach के लिए Rule 15 आदि specific procedural provisions हैं, लेकिन Section 24 की free-copy requirement के लिए अलग rule नहीं दिया गया है।

इसलिए Section 24 की मुख्य authority स्वयं Act का statutory mandate है।

Form IV और Order की Copy

Rules का Form IV aggrieved person को उसके rights और available remedies की जानकारी देने वाला prescribed format है।

इसमें उसे Court से विभिन्न orders प्राप्त करने के अधिकार के साथ-साथ complaint, applications, medical reports और अन्य relevant statements की copies प्राप्त करने के अधिकार की जानकारी भी दी जाती है।

इस broader information framework के साथ Section 24 Court द्वारा पारित orders की free copies सुनिश्चित करता है।


Section 24 का Practical Example

मान लीजिए Magistrate ने Section 18 के तहत respondent के विरुद्ध Protection Order पारित किया।

ऐसी स्थिति में Magistrate को order की copy बिना किसी cost के:

aggrieved person और respondent

उस Police Station के officer-in-charge जहाँ Magistrate से approach किया गया

और

Court की local jurisdiction में स्थित relevant service provider

को उपलब्ध कराने का आदेश देना होगा।

यदि किसी service provider ने Domestic Incident Report register की थी, तो उस service provider को भी copy दी जाएगी। [DV Act, 2005, s.24]

यदि respondent बाद में Protection Order का breach करता है, तो Rule 15 के अनुसार breach की complaint के साथ protection order की copy Magistrate को भेजी जा सकती है।

इस प्रकार Section 24 order → communication → enforcement की chain में महत्वपूर्ण भूमिका निभाती है।

Section 24 को याद रखने का सरल तरीका

“हर DV Act Order की Copy — Free of Cost.”

Copy जाएगी:

Parties को

Concerned Police Officer को

Local Service Provider को

और

DIR register करने वाले Service Provider को।

निष्कर्ष

धारा 24 एक procedural लेकिन अत्यंत महत्वपूर्ण protective provision है। इसके तहत Magistrate द्वारा DV Act के अंतर्गत पारित हर order की copy free of cost संबंधित parties, concerned Police Station के officer-in-charge और Court की local jurisdiction में स्थित service provider को उपलब्ध कराने का आदेश दिया जाना अनिवार्य है। यदि किसी service provider ने Domestic Incident Report register की है, तो उसे भी order की copy दी जानी है। [DV Act, 2005, s.24]

इस धारा का मुख्य उद्देश्य order की जानकारी, accessibility और effective enforcement सुनिश्चित करना है।

Section 24 → Free copy of Court Order

Section 25 → Duration / Alteration of Orders

Section 26 → Relief in other proceedings

Section 27 → Jurisdiction और पूरे भारत में enforcement

Section 28 → Procedure

Section 29 → Appeal

इस प्रकार Section 24, Chapter IV में relief मिलने के बाद उस relief के आदेश को संबंधित parties और enforcement authorities तक पहुँचाने वाली महत्वपूर्ण कड़ी है।
